                      Relating to Exemptions Und‘er Section 27156
                              of the California Vehicle Code

                                 Subaru of America, Inc. .
                                     SPT Air Intakes

Pursuant to the authority vested in the Air Resources Board by Section 27156 of the
Vehicle Code; and                                                             .

Pursuant to the authonty vested in the underS|gned by Section 39515 and Sectlon
39516 of the Health and Safety Code and Executlve Order G—02003;

IT IS ORDERED AND RESOLVED: That the installation of the SPT Alr Intakes,
marketed by Subaru ofAmerica, Inc., and produced by Dee Zee Manufacturing of 1572
N.E. 58°" Avenue, Des Moines, lowa 50313 has been found not to reduce the
effectivenessof the applicable vehicle pollution control systems and, therefore, is
exempt from the prohibitions of Section 27156 of the Vehicle Code for the vehicles

Note: (1) The models certified at the partial zero—emission—vehicle (PZEV)
emission level are excluded from this exemption. These include the test group
7FJXBO2.5NVD from the 2007 model year, the test groups 8FJXBO2.5NVJ and
8FJXBO2.5NVD from the 2008 model year, and the testgroup 9FJXJO2.5NVD from
the 2009 model year.                                                          ‘

This Exeoutlve Order is valid prowded that the installation instructions for the SPT Air
Intakes will not recommend tuning the vehicle to specifications different from those of
the vehicle manufacturer


 Changes made to the design or operating conditions of the SPT Air Intakes, as exempt
 by the Air Resources Board, which adversely affect the performance of the veh(cles
 pollution control system shall invalidate this Executlve Order.

 Marketing of the SPT Air lntakes using any identification other than that shown is this
 Executive Order or marketing of the SPT Air Intakes for an application other than those
 listed in this Executive Order shall be prohibited unless prior approval is obtained from
 the Air Resources Board.

 This Executive Order does not constitute an opinion as to the effect the use of the SPT
 Air Intake unit may have on any warranty either expressed or implied by the vehicle
 manufacturer.

  This Executive Order is granted based on previously submitted emissions test results
  in the modified configuration using the Cold—Start CVS—75 Federal Test Procedure, —
  and an examination of the On—Board Diagnostic II (OBD II) system. A 2006 Subaru
  Impreza WRX with a 2.5 liter turbocharged engine (6FJXVO2.5PRA, LEV—I[ LEV) was .
  used for the evaluation of the SPT Air Intake. Results from emissions testing
. conducted at Automotive Testing Laboratorles of Mesa, Arlzona are shown below (in
 grams per mile}):

  The emission test results in the modified configuration were below the applicable
© certification standards. Examination of the OBD II system showed the SPT Air Intakes
  will not affect OBD II operation.

 If evidence provides the Air Resources Board with reason to suspect that the SPT Air .
 Intakes will affect the durability of emission control systems, Subaru of America, Inc.,
 and Dee Zee Manufacturing shall be required to submit durability data to show that the
 durability of vehicle emission control systemsare not, in fact, affected and/or that the
 add—on or modified part demonstrates adequate durability.

 The Alr Resources Board reserves the rlghtin the future to review this Executive Order
 and the exemption provided herein to assure that the exempted add—on or modified part
 continues to meet the standards and procedures of Title 13, California Code of
 Regulations, Section 2222, et seq.

ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE
AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING
ANTJI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE SUBARU OF
AMERICA, INC., SPT AIR INTAKES.

No claim of any kind, such as "Approved by the Air Resources Board", may be made
with respect to the action taken herein in any advertlsmg or other oral or written
 commumcatxon

Violation of any of the. above condltlons shall be grounds for revocation of this order.
The order may be revoked only after a ten—day written notice of intention to revoke the _
 order, in which period the holder of the order may request in writing a hearing to contest
  the proposed revocation. If a hearing is requested, it shall be held within ten days of
. receipt of the request and the order may not be revoked until a determmatlonis made
  after the hearmg that grounds for revocation exist.                                     .
