"OETTINGER/OKRASA VOLKSWAGEN ENGINE MODIFICATION KIT" Pursuant t o t h e a u t h o r i t y vested i n t h e A i r Resources Board by S e c t i o n 27156 o f t h e V e h i c l e Code; and Pursuant t o t h e a u t h o r i t y vested i n t h e undersigned by Sections 39515 and 39516 o f t h e H e a l t h and S a f e t y Code and Executive Order G-45-5; I T I S ORDERED AND RESOLVED: That t h e i n s t a l l a t i o n o f t h e "Oettinger/OKRASA Volkswagen 1800 cc Engine M o d i f i c a t i o n K i t " manufactured by Power Haus Products Inc. has been found n o t t o reduce t h e e f f e c t i v e n e s s o f r e q u i r e d motor v e h i c l e p o l l u t i o n c o n t r o l devices and, t h e r e f o r e , i s exempt from t h e p r o h i b i t i o n s of S e c t i o n 27156 o f t h e Vehicle Code f o r 1976 through 1982 Volkswagen Rabbit, Scirocco, Dasher, Golf, and Audi Fox model vehicles. This Executive Order i s v a l i d provided t h a t i n s t a l l a t i o n i n s t r u c t i o n s f o r t h i s d e v i c e w i l l n o t recommend t u n i n g t h e v e h i c l e t o s p e c i f i c a t i o n s d i f f e r e n t from those submitted by t h e d e v i c e manufacturer. Changes made t o t h e design o r o p e r a t i n g c o n d i t i o n s o f t h e device, as exempted by t h e A i r Resources Board, t h a t adversely a f f e c t t h e performance of a v e h i c l e ' s p o l l u t i o n c o n t r o l system s h a l l i n v a l i d a t e t h i s Executive Order. Marketing o f t h i s d e v i c e u s i n g an i d e n t i f i c a t i o n o t h e r than t h a t shown i n t h i s Executive Order o r marketing o f t h i s d e v i c e f o r an a p p l i c a t i o n o t h e r t h a n those l i s t e d i n t h i s E x e c u t i v e Order s h a l l be p r o h i b i t e d unless p r i o r approval i s o b t a i n e d from t h e A i r Resources Board. Exemption o f a k i t s h a l l n o t be construed as an exemption t o s e l l , o f f e r f o r s a l e o r a d v e r t i s e any component o f a k i t as an i n d i v i d u a l device. This Executive Order does n o t c o n s t i t u t e any o p i n i o n as t o t h e e f f e c t t h a t t h e use o f t h i s d e v i c e may have on any warranty e i t h e r expressed o r i m p l i e d by t h e v e h i c l e manufacturer. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTI-POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE "OETTINGER/OKRASA VOLKSWAGEN ENGINE MODIFICATION KIT". No c l a i m o f any kind, such as "Approved by A i r Resources Board" may be made w i t h r e s p e c t t o t h e a c t i o n taken h e r e i n i n any a d v e r t i s i n g o r o t h e r a o r a l o r w r i t t e n communication.

EXECUTIVE ORDER D-102-1 "OETTINGER/OKRASA VOLKSWAGEN (Page 2 of 2 ) e ENGINE MODIFICATION KIT" Section 17500 of t h e Business and Professions Code makes untrue o r misleading advertising unlawful, and Section 17534 makes violation punishable as a misdemeanor. Section 43644 of the Health and Safety Code provides as follows: "43644. ( a ) No person s h a l l i n s t a l l , s e l l , o f f e r f o r s a l e , o r advertise, o r , except in an application t o the s t a t e board f o r c e r t i f i c a t i o n of a device, represent, any device as a motor vehicle pollution control device f o r use on any used motor vehicle unless t h a t device has been c e r t i f i e d by the s t a t e board. No person s h a l l s e l l , o f f e r f o r s a l e , advertise, o r represent any motor vehicle pollution control device as a c e r t i f i e d device which, i n f a c t , is not a c e r t i f i e d device. Any violation of t h i s subdivision i s a misdemeanor." Any apparent violation of the conditions of this Executive Order will be submitted t o t h e Attorney General of California f o r such action as he deems advisable.
