State of California AIR RESOURCES BOARD EXECUTIVE ORDER D—126—38 Relating to Exemptions under Section 27156 of the California Vehicle Code General Motors Service Parts Operations Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Sections 39515 and 39516 of the Health and Safety Code and Executive Order G—14—012; IT IS ORDERED AND RESOLVED: That the installation of the Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit, manufactured and marketed by General Motors Service Parts Operations, 6200 Grand Pointe Drive, Grand Blanc, Michigan 48439, has been found not to reduce the effectiveness of the applicable vehicle pollution control systems and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for the following vehicle applications: Model Model Years Engine Part# Cruze (Base) 2012 to 2015 1.4L 23494247 Cruze RS 2012 to 2015 14L 23233811 Buick Regal (All) 2012 and 2013 2.OL 12653664 Sonic (Non RS 5 Door) 2012 to 2015 14L 23444736 Sonic (RS 5 Door) 2012 to 2015 14L 23444737 Sonic (Non RS 4 Door) 2012 to 2015 1 4L 23451716 Sonic (All) 2012 to 2015 14L 23169952 The LHU Turbocharged ECOTEC Upgrade Kit (12653664) for the 2012 and 2013 model year 2.0L Buick Regal includes the following main components: new air intake tubing with an open element air cleaner and a new electronic control unit calibration with no user adjustments. Chevrolet Cruze and Sonic 1.4L Stage Kit (23494247, 23233811, 23444736, 23444737, and 23451716) includes a new electronic control unit calibration with no user adjustments and an exhaust system after the catalyst, catalyst not modified for installation. Sonic 1.4L Cold Air Induction Kit (23169952) includes new air intake tubing with an open element air cleaner only.

& This Executive Order is valid provided that the installation instructions for the Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit will not recommend tuning the vehicle to specifications different from those submitted by the vehicle manufacturer. Changes made to the design or operating conditions of the Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit, as exempt by the Air Resources Board, which adversely affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order. Marketing of the Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit using any identification other than that shown in this Executive Order or marketing of the Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit, for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. This Executive Order shall not apply to any Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit advertised, offered for sale, sold with, or installed on a new motor vehicle prior to or concurrent with transfer to an ultimate purchaser. This Executive Order does not constitute any opinion as to the effect the use of the Sonic 1.4L Cold Air Induction Kit, Chevrolet Cruze and Sonic 1.4L Stage Kit and LHU Turbocharged ECOTEC Upgrade Kit may have on any warranty either expressed or implied by the vehicle manufacturer. This Executive Order is granted based on submitted emissions test data generated on a 2013 model—year 2.0L turbocharged Buick Regal GS (test group DGMXVO2.0001), certified to the Low Emission Vehicle II Ultra Low Emission Vehicle (LEV II ULEV) emission standards with the LHU Turbocharged ECOTEC Upgrade Kit installed. Testing consisted of a Cold—Start CVS—75 Federal Test Procedure (FTP) and the Supplemental Federal Test Procedure (SFTP USO6) test cycle. Results are in grams per mile with assigned deterioration factors added to the CVS—75 FTP results. Emission levels of the modified vehicle met the applicable emission standards. g. On—Board Diagnostic II (OBD 1I) test data showed that the LHU Turbocharged ECOTEC Upgrade Kit did not affect the ability to perform OBD II monitoring. The Chevrolet Cruze and Sonic 1.4L Stage Kit and the Sonic 1.4L Cold Air Induction Kit, should have a similar effect on emissions and OBD II monitoring. No claim of any kind, such as "Approved by the Air Resources Board," may be made with respect to the action taken herein in any advertising or other oral or written communication. In addition to the foregoing, the Air Resources Board reserves the right in the future to review this Executive Order and the exemption provided herein to assure that the exempted add—on or modified part continues to meet the standards and procedures of California Code of Regulations, Title 13, Section 2222, et seq. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE GENERAL MOTORS SERVICE PARTS OPERATIONS SONIC 1.4L COLD AIR INDUCTION KIT, CHEVROLET CRUZE AND SONIC 1.4L STAGE KIT AND LHU TURBOCHARGED ECOTEC UPGRADE KIT. Violation of any of the above conditions shall be grounds for revocation of this Executive Order. The Executive Order may be revoked only after a ten—day written notice of intention to revoke the Executive Order, in which period the holder of the Executive Order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request, and the Executive Order may not be revoked until a determination is made after a hearing that grounds for revocation exist.
