                            of the Vshlicle Code

   TURBOCHARGER KiT MODEL NO. 6.2G FOR CHEVROLET/GMC HEAYY—DUTY YVEHICLES
                   POWERED BY A 6.2 L!ITER GENERAL MOTORS
                          HEAVY—DUTY DIESEL ENGINE

Pursuant to the authority vested   in the Alir Resources Board by Section 27156
of the Vehiclie Code; and

Pursuant to the authority vested in the undersigned by Sections 3§515 and
39516 of the Health and Safety Code and Executive Order G—45—5;

1T IS ORDERED AND RESOLVED:    That the   Installatlon of the add—on
turbocharger kit mods! No. 6.2G manufactured by Galse Banks Engineering,
546 Duggan Avenue, Azusa, California 91702, using a Rotomaster turbocharger
Mode! No. TO4B with an A/R ratio of 1.0 has been found not to reduce the
sffectiveness of required motor vehicie pollution control devices and,
thersefore, is exempt from the prohibitions. of Section 27156 of the Vehlicie
Code for 1982 through 1987 model—year Chevrolet/CMC heavy—duty vehicies and
1988 through 1989 model—year 3/4 ton and 1 ton Crew Cab and 3/4 ton
Suburban, powered by a §.2 ilter General Motors heavy—duty engine.

Modiflcatlons to the OEM emission—related parts duse to the Iinstaliation of
the turbocharger kit includs a new alr cleaner assembly, a new 3" low—
restriction muffier and 3" dlameter exhaust pipe.

This Executive Order is valid provided that installatlon instructions for
this device will not recommend tuning the vehicls to specifications
different from those submltted by the devicse manufacturer.

Changes made to the design or cperating conditions of the device, as
exempted by the Air Resources Board, that adverseily affect the performancse
of a vehnicle‘s poliution control system shall      invalidate this Executive
Order .

Marketing of this devicse using an identiflcation other than that shown in
this Executive Order or marketing of this device for an appiication other
than those iisted in this Executive Order shall be pronibited unless prlor
approval Is obtained from the Air Resources Board.   Exemption of a kit shall
not be constrused as an exemption to seli, offer for saile, or advertlise any
component of a kit as an individual deyvice.

This Executive Order does not constitutse any opinion as to the effect'that
the use of this device may have on any warranty either— éxpressed or implied
by the vehlcls manufracturer.

CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY ALLEGED
BENEFITS OF THE GALE BANKS ENGINEERING TURBOCHARGER KIT MODEL NO. 6.2G FOR
INSTALLATION ON CHEVROLET/GMC VEHICLES POWERED 8Y A 6.2 LITER GENERAL MOTORS
HEAVY—OUTY DIESEL ENGINE.

No ciaim of any kind, such as "Approved by Air Resources Board" may be made
with respect to the action taken hersin in any advertising or other oral or
wr i tten communication.

Section 17500 of the Business and Professlons Code makes untrue or
misieading advertising uniawful, and Section 17534 makes violation
punishable as a misdemeanor .

Section 43644 of the Heaith and Safety Code provides as follows:

     "43644.   (a)   No person shall   Install, seill, offer for sale, or
     advertise, or, except in an appllication to the state board for
     certifilcation of a device, represent, any device as a motor
     vehiclie poliiution controel| deviecs for uss on any used motor
     vehicle unless that device has been certifled by the state board.
     No person shall seill, offer for sale, advertisa, or represent any
     motor vehicls pollutlon scontrol desviecs as a certified device
     which, in fact, is not a certified device.       Any vioilation of this
     subdlvision is a misdemeanor."

Any ‘apparent v!olatlon of the conditions of thlis Executlive Order wili be
submitted to the Attorney General of California for such action as he deems
advlisable.

Executlive Order No. D—161—3, date1 October 23,    1986,   is superseded and of no
further force and effect.

            Gale        Banks       Engineering              (Banks)        has       requested      an   update      to

the    exemption         from       the    prohibitions               in    VYehicle         Code    Section       27156

for     their         add—on         turbocharger                   kit    mode!       No.    6.2G    designed       for

Chevrolet/GMC            heavy—duty                diesel!      engines.

             The        request           is        to     include         the    1988       through      1989     mode!

year    heavy—duty            3/4    and       1    ton    Crew      Cab     and        heavy—duty           3/4     ton

Suburban          applications .                   This    would      make       the    exemption         applicable

to    the   1982—1989             Chevrolet/GMC                     heavy—duty          vehicles          which      are

powered          by     the       General            Motors          6.2     Liter           heavy—duty          diese!

engine .

             Based           on     the        fact        t ha t     Banks           was    previously         granted

exemption         for    the      1982—1987 mode!                   years    and       that    the    1988      through

1989    General         Motors       engine          family         GMO6.2DAB          was    carried       over    from

the    1987 model—year               for       the       Crew       Cab    ~and        Suburban,          the      staff

concludes             that    Banks       6.2G       turbocharger            system will             have    the    same

degree      of    performance/emissions                         impact      on    the       1988     through        1989

model—year             engines        as       it    has     on     the    1987       and    earlier      model—ysar

engines .

             Therefore,              the       staff       recommends            that       Banks    be   granted     an

update      and       that    Executive             Order       D—161—13         be    issued.

emissions          tests       performed on              a    1986    Chevrolet             Suburban           heavy—duty

diesel!    truck,         and    the     1989        certification                    documents               which        show

that      the      General       Motors        engine          family          GMO6.20AB          was     a    carry—over

from    1987       for    Crew Cab        and       Suburban,             the    staff       concludes              that    the

installation              of     _the     Banks          turbocharger                kit    model!      No.     6.2G wi l l

not    adverseiy          affect        exhaust          emissions             from    the       1988     through          1989

Crew      Cab       and         Suburban           vehicles           for       which       the    update           has    been

requested.

                    The          previous.          evaluation               of        the     Banks        68.2%G   turbocharger

          system          showed        that       it    did     not    cause          an    adverse        emissions         effect

          when            installed          on a        1987 Chevrolet                 Suburban.           Since     the General

          Motors          GMO6.2DAB          engine            family    for       Crew Cab          and    Suburban        has   not

          been        changed              for      the         1988    through             1989 model—year,           no    adverse

          emissions effect will                          occur by        the       installation of              the Banks 6.2G

          turbocharger                 system       on    the     1988       through          1989 model—year           vehicles.

                    An     update          should        be    granted            and        Executive         Order        D—161—13

          should          be     issued.
