Pursuant—to the authority vested»in the»hir Resources Board by Section 27156
of the Vehicle Code; and                   .

Pursuant to the authority vested in the undersiqgned by Section 39515 and
39516 of the Health and Safety Code and Executive Ordezr G—45—S5;

IT IS ORDERED ANQ RESOLVED:  That the installation of the Exhaust System
(Less Manifolds}, part nos. 49213 & 49040 manufactured by Gale Banks
Engineering of 546 Duggan Avenue, Azusa, California 91702, has been found
not to reduce the effectiveness of required motor vehicle pollution control
devices, and therefore is exempt from the prohibitions of Section 27156 of
the Vehicle Code for installation on 14,000 lbs. or agrsster 1990—93 General
Motors motorhomes with a 7.4L (454 CID) gasoline engirs on a P—30 chassis,
and 1989—93 Ford motorhomes with:a 7 5L (460 CID) gaszline engine on either
a Ford or Oshkosh chassis.

This exemption shall not apply to gfiy compenemt, apparatus, or mechanism
advertised, offered for sale or sold with, or installed on, a motor vehicle
prior to or concurrent with transfer to an ultimate purchaser.

This Executive Order is valid provided that installatizsn instructions for
the components will not recommend tuning the vehicle ts specifications
different from those submitted by the manufacturer.

Changes made to the design or operating conditions of the components, as
exempted by the Air Resources Board, that adversely affsct the performance
of a vehicle‘s pollution control system shall invalide:s this Executive
Order.                            ——        -

Marketing of the components using an identification otz:er than that shown in
this Executive Order or marketing of the components fco=: an application other
than those listed in this Executive Order shall be prs:ibited unless prior
approval is obtained from the Air Resources Board.

This Executive Order does not constitute any opinion &s to the effect that
the use of this component may have on any warranty eitzer expressed or
implied by the vehicle manufacturer.

THIS EXECUTIVE OGRDER DOES NOT CONSTITUTE A CERTIFICATICK, ACCREDITATION,
APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RZSOURCES BOARD OF ANY
CLAIMS OF THE APPLICANT CONCERNING ANTI*POLLETION BENEFTITS OR ANY ALLEGED
BENEFITS OF THE EXHAUST SYSTEM.

                     Section 17500 of the Business and Professions Code makes untrue or
                     misleading advertising unlawful, and Section 17534 makes violation
                     punishable as a misdemeanor.

                     Section 43644 of the Health and Safety Code provides as follows:

                          "43644,  ({a) No person shall install, sell, offer for sale, or
                          advertise ‘or except in an application to the state toard for
                          certification of a device,    represent,    any device as a motor vehicle
                          pollution control device for use on any used motor vehicle unless that
                          davice haggbeen certified by the state board.   No person shall sell,
                         _offer——for sale, advertise, or represent any motor vehicle pollution
                «—        control device as a certified device which,      in fact,   is not a certified
                          device.   Any violation of this subdivision is a misdemeanor."

                     Any apparent violation of the conditions of this Executive Order will be
                     submitted to the Attorney General of California for such action as he deems
                     advisable.
