(Page 1 of 2) State of California AIR RESOURCES BOAPD EXECUTIVE ORDER D—216—10 Relating to Exemptions Under Section 27156 ‘ of the Vehicle Code J. BITTLE AMERICAN, IHNC. SHORTY HEADERS Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Sections 39515 and 39516 of the Health and Safety Code und Executive Order G—45—5; IT IS ORDERED AND RESOLVED: That the installation of the Shorty Headers manufactured out of #14 gage steel by J. Bittle American, Inc. of 7149 Mission Corge Road, San Diego, California 92120, have been found not to reduce the effectiveness of the applicable vehicle pollution control system and, therefore, are exempt from the prohibitions of Section 27156 of the Vehicle Code for the following Ford Motor Company vehicles: part No. VEhicle'AgglicatiSn 1620 & 1624 1986—93 5.0L Mustangs 1990~—93 5.0L Thunderbirds 1627 & 1628 . 1985—93° 5.0 or S;SL trucks 1633 1990—93 4.0L Ford/Mazda trucks 1629 © 1988—93 7.5L trucks This Executive Order is valid provided that installation instructions for the Shorty Headers will not recommend tuning the vehicle to specifications different from those submitted by J.iBittle Azerican, Inc. Changes made to the design or operating conditions of the headers, as exempt by the Air Resources Board, which adversely aifect the performance of a vehicle‘s pollution control system shall invelidate this Executive Order. Marketing of these headers using any identification cther than that shown in this Executive Order or marketing of the headers for an application other than those listed in this Executive Order shall be prohibited unless prxor approval is obtained from the Air Resources Board. This Executive Order does not constitute any spinion as to the effect the use of this headers may have on any warranty sither expressed or implied by the vehicle manufacturer. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUIION BENZFITS OR ANY ALLEGED BENEFITS OF J. BITTLE AMERICAN‘S #14 GAGE STEZL SHORTY HEADERS.

Violation of any of the above conditions shall be groumds for revocation of this order. The order may be revoked only after ten Cay written notice of intention to revoke the order, in which period the holdjer of the order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request and the order may not be revoked until a deter*xnat;on after hearing that grounds for revocation exist.
