(Page 1 af 2), State of California 0 AIR RESOURCES BOARD EXECUTIVE ORDER D~—245—2 Relating to Exemptions Under Sectiocr 27156 of the Vehicle Code BBK PERFORMANCE, INC. 65MM (P/N 1517), 70MM (P/N 1501) AND 75MM (P/N 15°3) THROTTLE BODIES Pursuant to the authority vested in the Air Resources Board by Section 27156 . whe Vehicle Code; and & » Pursuant to the authority vested in the undersigned ty Sections 39515 and 39516 of the Health and Safety Code and Executive Ordar G—45—5; IT IS ORDERED AND RESOLVED: That the installation of the BBK Performance, Inc.‘s 65mm throttle body, P/N 1517, with exhaust gas recirculation (EGR) spacer plate, P/N 1518, 70mm throttle body, P/N 1501, with EGR spacer plate, P/N 1502, and 75mm throttle body, P/N 1503, with EGR spacer plate, P/N 1504, manufactured by BBK Performance, Inc. of 2451 Pomona Rincon, Corona, California 91720 have been found not to reduce the effectiveness of the applicable vehicle pollution:control system and, thersfore, are exempt from the prohibitions of Section 27156 of the Vehicle Cods for 1993 and older model~—year Ford, Lincoln and Mercury passenger cars equipped with a 5.0 liter electronic fuel—injected engine. This Executive Order is valid provided that installagion instructiongs for this throttle body will not recommend tuning the vehicle to—specifications different from those submitted by BBK Performance, Izc. Changes made to the design or operating conditions of the throttle body, as exempt by the Air Resources Board, which adversely affect the performance of a vehicle‘s pollution controlsystem shall invalidate this Executive Order. / Marketing of this throttle body using any identification other than that shown in this Executive Order or marketing of this t:rottle body for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. Exemption of the throttle body shall not be construe: as exemption to sell, offer for sale, or advertise any component of the kit as an individual device. This Executive Order does not constitute any opinion as to the effect the use of this throttle body may have on any warranty either expressed or implied by the vehicle manufacturer. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIZ RESOURCES BOARD OF CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENZFITS OR ANY ALLEGED BENEFITS OF BBK PERFORMANCE INC.‘S THROTTLE BODY.

The order may be revoked s1ly after ten day written notice of intention to revoke the order, in which period the holder of the order may request in writing a hearing to cortest the proposed revocation. If a hearing is requested, it shall be zeld within ten days of receipt of the request and the order may not be revcred until a determination after hearing that grounds for revocation exist.
