State of Caffomia AIR RESOURCES BCARD EXECUTIVE ORDER D—260—28 Relating to Examptions Under Section 27156 of the Calffornia Vehicle Code K&N Enginesring Fitercharger Injaction Performance Kit Pursuant to the authority vested in the Air Resources Board by Secion 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Section 39616 and Section 39516 of the Health and Safety Code and Executive Order G—02—00; iT 1 ORDERED AND RESOLVED: That the installation of the Filtercharger Injection Performance Kit, produced and marketed by K&N Engineering of 1455 Citrus Ave., Riverside, Calfornia 82507, has been found nat to reduce the effectiveness of the applcable vehicle pollution control systems and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for the vehicles fisted in Extibit A. The Fillercharger Injection Performance Kit includes the following main components: open—clement reusable aifiter, heat shield (as applicable), intake system tubing, crankease ventifation hose (as applicable, which may be silicone, and a color other than black), assorted brackets, and hardware, This Executive Order is valid provided that the installation instructions for the Fitercharger injgetion Porformance Kit willnot recommend tuning the vehicle to specifications different from thase of the vahicle manufacturer. Chenges made to the design or operating conditions of the Filtercharger Injection Performance Kit, as exempt by the Alr Resources Board, which adversoly affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order. This Executive Order shall not apply to any Aiftercharger Injection Performance Kit advertised, offered for sals, sold with, or instailed on a new motor vehicle prior to or concurrent with transfer to an uftimate purchaser. Marketing of the Filtercharger Injection Performance Kit using any identifcation other than that shown in this Executive Order or marketing of the Fitercharger Injection Performance Kit for an application ather than those listed in this Exeoutive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. This Executive Order does not constitute any opinion as to the effect the use of the Fitercharger Injection Performance Kit units may have on any warrenty either expressed or implied by the vehicle manufacturer.

This Executive Order is granted based on emission test resultsin the modified configuration using the Cold—Start CVS—75 Rederal Test Procedure, Supplemental Federal Test Procedure (US06), and an examination of the On—Bosrd DiagnostiIl (OBD i) system. A 2004 Chrysler PT Cruiser with a 2.4 liter engine (4CRXVO2.AVEO, LEV—1l LEV) was used for the evaluation of the Fitercharger Injection PerformanceKi. Examination of the OBD II system showed the Filtercharger injection Performance Kit does not affect OBD II aperation. If evidence provides the ARB with reason to suspect that the Filtercharger Infection Performance Kit will affect the durabiity of emission control systems, K&N Engineering ‘ shall be required to submit durabilty data to show that the durabiity of vehicle emission control systems are not, in fact,affected and/or thatthe add—on or modified part demonstrates adequste durabilty. The ARB reservas the right in the future to review this Executive Order and the exemption provided herein to assure that the exempted add—on or modified part continues to maet the standards and procedures of Title 13, California Code of Requlations, Section 2222, ot seq. Vielation of any of the above conditions shall be grounds for revocation of this order. The arder may be revoked only after a ten—day writen notice of intention to revoke the arder, in which period the holder of tha rder may requestin writing a hearing to contast the proposed revocation. If a hearing is requested, it shall be held within ten days of reselpt of the request and the arder may not be revoked untl a determination is made after the hearing that grounds for revocation exist.
