S & S Replacement Engine Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority in the undersigned by Section 395 15 and Section 395 16 of the Health and Safety Code and IT IS ORDERED AND RESO VED: That the installation of the S & S Replacement Engine, ," manufactured and marketed by S & S Cycle, Inc., Route 2 Highway G, Viola, Wisconsin 54664 has been found not to reduce the effecti eness of the applicable motorcycle pollution control system and, therefore, is exempt from the prohibition4 of Section 27156 of the Vehicle Code for all 1970 to 1998 Harley- Davidson Motorcycles originally equipped with a carbureted, non-catalyst, Big Twin-Evolution engine as listed below: Part No. Displacement Model-Year 31-9150 80 cubic inch 1984-98 31-9151 88 cubic inch 1984-98 31-9152 89 cubic inch 1984-98 3 1-9153 90 cubic inch 1984-98 3 1-9154 93 cubic inch 1984-98 31-9155 96 cubic inch 1984-98 3 1-9156 96 cubic inch 1984-98 3 1-9157 79 cubic inch 1970-84 3 1-9158 88 cubic inch 1970-84 The S & S Replacement ~ n ~ i is b aecomplete new engine which includes but not limited to the main components listed in Exhibit A of this Executive Order. This Executive Order is valid provided that the installation instructions for the S & S Replacement Engine will not recommend tuning themotorcycle to specifications different from those of S & S Cycle, Inc. Changes made to the design or loperating conditions of the S & S Replacement Engine, as exempt by the Air Resources Board, which adversely affect the performance of the motorcycle's pollution control system shall invalidate this Executive order. Marketing of the S & S ~eplackmentEngine using any identification other than that shown in this Executive Order or marketing +f the S & S Replacement Engine for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. Exemption of the S & S Repla~ementEngine shall not be construed as exemption to sell, offer for sale, or advertise any component of th$ kit as an individual device. This Executive Order does not constitute any opinion as to the effect the use of the S & S Engine Package may have on any warranty either expressed or implied by the motorcycle manufacturer.

No claim of any kind, such as "Approved by the Air Resources Board", may be made with respect to the action taken herein in any advertising or other oral or written communication. Violation of any of the above conditions shall be grounds for revocation of this order. The order may be revoked only after a ten-day written notice of intention to revoke the order, in which period the holder of the order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request and the order may not be revoked until a determination after hearing that grounds for revocation exist.
