State of Calfornia AIR RESOURCES BOARD EXECUTIVE ORDER D—365—9 Relating to Exemptions Under Section 27156 of the Califoria Vehicle Code Accessible Technologies, Inc. ATI Procharger Pursuant to the authority vested in the Air Resources Board (ARB) by Section 27156 of the Vehicle Code (VC); and Pursuant to the authorty vested in the undersigned by Section 39515 and Section 39516 of the Health and Safety Code and Executive Order G—14—012; IT IS ORDERED AND RESOLVED: That installation of the ATI Procharger, produced and marketed by Accessible Technologies, Inc. (AT) of 14801 West 114" Terrace, Lenexa, Kansas 66215, has been found not to reduce the effectiveness of the applicable vehicle polfution control systems and, therefore,is exempt from the prohibitions of Section 27156 of the Vehicle Code for the vehicles listed in the attached Exhibit A TheATI Procharger includes the following main components: P—18C—1 Procharger, modified drive belt system, intake tubing with open elementair fter, air to air intercooler, supercharger by—pass valve, new Electronic Control Unit (ECU) software calibration without user adjustments, replacementfuelinjectors, fuel pump boost switch (Flow Charger), harmonic balancer, thermostat housing, and coolant tank. Maximum boost pressure, supercharger pulley size, and crank pulley sizeis listed in Exhibit A. The stock radiator thermostat and throitle body are retained. The PCV and crankease breather hose may be replaced or modified with an SAE3ORS rated hose or an equivalent Chrysler replacement. This Executive Order is valid provided that installation instructions for the ATI Procharger will not recommend tuning the vehicle to specifications different from those of ATI Changes made to the design or operating conditions of the ATI Procharger, as exempt by ARB, which adversely affect the performanceof the vehicle‘s pollution control system shall invalidate this Executive Order This Executive Order shall not apply to any ATI Procharger advertised, offered for sale, sold with, or installed on a new motor vehicle prior to or concurrent with transfer to an ultimate purchaser

Marketing ofthe ATI Procharger using any identification otherthan that shown in this Executive Order or marketing of the ATI Procharger for an application other than those listed in this Executive Order shall be prohibited unless prior approvalis obtained from ARB. This Executive Order does not constitute any opinion as to the effect the use of the ATI Procharger may have on any warranty either expressed or implied by the vehicle manufacturer This Executive Order is granted based on previous emission test results and examinations of the On—Board Diagnostc II system. ARB reserves the right in the future to review this Executive Order and the exemption provided herein to assure that the exempted add—on or modified part continues to mest the standards and procedures of Title 13, California Code of Regulations, Section 2222, et seq. Further, if test results or other evidence provides ARB with reason to suspect that the ATI Procharger will affect the durabilty of emission control systems, ATI shall be required to submit durabilty data to show that the durabilty of vehicle emission control systems are not, in fact, affected and/or that the add—on or modified part demonstrates adequate durabilty. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE AT PROCHARGER No claim of any kind, such as "Approved by the Air Resources Board®, may be made with respect to the action taken herein in any advertising or other oral or written communication. Vielation of any of the above conditions shall be grounds for revocation of this order. The order may be revoked only after a ten—day written notice ofintention to revoke the order, in which period the holder ofthe order may request in writing a hearing to contest the proposed revocation.
