                  Relating to Exemptions Under Section 27156
                             of the Vehicle Code

              FERRARA INT‘L. ENVIRONMENTAL PRODUCTS CO., INC.
                 FUEL TREATMENT DEVICES PFTD—10 AND CFTD—2

WHEREAS, Vehicle Code Section 27156 and Title 13 California Code of
Regulations (hereafter "CCR") Section 2222(e), authorizes the California Air
Resources Board   (ARB)   and its Executive Officer to exempt add—on and
modified parts from the prohibitions of Vehicle Code Section 27156.

 WHEREAS, Ferrara Int‘l. Environmental Products Co., Inc. of 37 West S56th
‘Street, Suite 3R, New York, New York 10019, has applied to the ARB for
exemption from the prohibitions of Vehicle Code Section 27156 for the Fuel
Treatment Devices PFTD—10 and CFTD—2.

WHEREAS, pursuant to the authority vested in the Executive Officer by Health
and Safety Code Section 39515 and in the Chief, Mobile Source Division by
Health and Safety Code Section 39516 and Executive Order G—45—5, the Air
Resources Board finds:

     1.   The Fuel Treatment Devices PFTD—10 and CFTD—2 are add—on devices
          that are attached to the fuel line in a motor vehicle.

     2.   The fuel line is part of the required motor vehicle pollution
          control system.

     3.   The Fuel Treatment Devices PFTD—10 and CFTD—2 are intended for use
          with a required pollution control system.

     4.   The Fuel Treatment Devices PFTD—10 and CFTD—2 by being installed
          on the fuel line alters the original design of a motor vehicle
          pollution control system.

     5.   The Fuel Treatment Devices PFTD~10 and CFTD—2 are devices subject
          to the prohibitions of Vehicle Code Section 27156 and an add—on
          part as defined by 13 CCR Section 1900(b)(1).

     6.   The Fuel Treatment Devices PFTD—10 and CFTD—2 do not reduce the
          effectiveness of any required motor vehicle pollution control
          device.

     7.   The ARB, in the exercise of technical judgement, is aware of no
          basis on which the Fuel Treatment Devices PFTD—10 and CFTD—2 will
          provide either a decrease in emission or an increase in fuel
          economy.

     8.   It has not been determined what effect use of the Fuel Treatment
          Devices PFTD—10 and CFTD—2 may have on any warranty, either
          expressed or implied, by the manufacturer of a motor vehicle on
          which the device is installed.

     9.   The Fuel Treatment Devices PFTD—10 and CFTD—2 are not certified
          motor vehicle pollution control devices pursuant to Health and
          Safety Code Section 43644.

                10.   The ARB by granting an exemption to Ferrara Int‘l. Environmental
                      Products Co.,   Inc.   for the Fuel Treatment Devices PFTD—10 and
                      CFTD—2 does not recommend or endorse in any way the Fuel Treatment
                      Devices PFTD—10 and CFTD—2 for emissions reduction,    fuel economy,
                      or any other purpose.

           IT IS HEREBY RESOLVED that the Puel Treatment Devices PFTD—10 and CFTD—2 are
           exempt from the prohibitions of Vehicle Code Section 27156 for installation
           on 1994 and older model—year gasoline and diesel powered vehicles subject to
           the following conditions:

                1.    This exemption shall not apply to any device, apparatus, or
                      mechanism advertised, offered for sale or sold with, or installed
                      on,   a motor vehicle prior to or concurrent with transfer to an
                      ultimate purchaser.

                      No changes are permitted to the devices as described in the
                      application for exemption.  Any changes to the devices, applicable
                      model year, or other factors addressed in this order must be
                      evaluated and approved by the ARB prior to marketing in
                      California.

                      Marketing of the devices using an identification other than that
                      shown in this Executive Order or marketing of the devices for an
                      application other than those listed in Executive Order shall be
                      prohibited unless prior approval is obtained from the ARB.
                      Exemption of this product shall not be construed as an exemption
                      to sell, ‘offer for sale, or advertise any component of the product
                      as an individual device.

                      Any oral or written references to this Executive Order or its
                      content by the Ferrara Int‘l. Environmental Products Co., Inc. its
                      principals, agents, employees, distributors, dealers, or other
                      representatives must include the disclaimer that the Executive
                      Order or the exemption it provides is not an endorsement or
                      approval of any fuel economy or emissions reduction claims for the
                      Fuel Treatment Devices PFTD—10 and CFTD—2 and is only a finding
                      that the devices are exempt from the prohibitions of Vehicle Code
                      Section 27156.

                      No claim of any kind, such as "Approved by the Air Resources
                      Board" may be made with respect to the action taken herein in any
                      advertising or other oral or written communication.

           Violation of any of the above conditions shall be grounds for revocation of
           this order.  The order may be revoked only after a ten—day written notice of
           intention to revoke the order,     in which period the holder of the order may
           request in writing a hearing to contest the proposed revocation.  If a
           hearing is requested, it shall be held within ten days of receipt of the
           request and the order may not be revoked until a determination after hearing
           that grounds for revocation exist.

                                         SUMMARY




          Ferrara International Environmental Products Co.,       Inc. of 37 West 56th

Street,    Suite 3R,   New York,   New York 10019,   has applied for exemption from the

prohibitions in Section 27156 of the California Vehicle Code for the Fuel

Treatment devices ?FTD-lO and CFTD—2.         The devices are designed for

installation on 1994 and older model—year gasoline and diesel powered vehicles.

          Previously the Air Resources Board (ARB) exempted three similar devices;

"Fuel Charger" by J. A. Lance Company, Inc.,          "Fuel—Energizer" by the Magnetizer

Group, Inc. and "Magna Charger" by B & D Research and Development.           Based on

the engineering evaluation of the Fuel Treatment devices PPTD—10 and CFTD—2

and exemptions iséued for the devices that operate in a manner similar to the

Fuel Treatment devices PFTD—10 and CFTD—2, the staff believes that the Fuel

Treatment devices PFTD—10 and CFTD—2 will not have any adverse effects on the

exhaust emissions from gasoline and diesel powered vehicles.

          The staff recommends that the Fuel Treatment Devices PFTD—10 and CFPTD—2

be exempted from the prohibitions in Vehicle Code Section 27156 and that

Executive Order D—366 be issued.

I.        INTRODUCTION

          Ferrara International Environmental Products Co.,     Inc.   of 37 West S6th

Street,    Suite 3R, New York, New York 10019,    has applied for an exemption from

the prohibitions of Vehicle Code Section (VC) 27156 for the Fuel Treatment

devices PFTD—10 and CFTD~2.       The devices are designed for installation on 1994

and older model—year gasoline and diesel powered vehicles.         The applicant

submitted installation instructions and specifications of the device for our

evaluation.




II.       CONCLUSIONS


          Previously, the Air Resources Board (ARB) exempted three similar

devices; "Fuel Charger" by J. A. Lance Company,       Inc.,   "Fuel—Energizer" by the

Magnetizer Group,       Inc. and "Magna Chargér" by B & D Research and

Development".       Based on the engineering evaluation of the device and the

exemptions issued to other devices that operate in a manner similar to the

Fuel Treatment devices PFTD—10 and CFTD—2,       the staff has determined the Fuel

Treatment devices PFTD—10 and CFTD—2 will not have any adverse effects on the

exhaust emissions from gasoline and diesel powered vehicles.




III.   RECOMMENDATION

          The staff recommends that Ferrara International Environmental Products

Co.,   Inc,   be granted an exemption from the prohibitions in California Vehicle

Code Section 27156 for the Fuel Treatment devices PFTD—10 and CFTD—2 and that

Executive Order D—~366 be issued.

IV.      DEVICE DESCRIPTION

         The Fuel iieatment device PFTD—10 is designed for installation on light—

duty gasoline vehicles and the CFTD—2 device is designed for installation on

heavy—duty gasoline and diesel vehicles.      The PFTD—10 is a magnetic oblong

shaped device that-comes in two sections.      Each section is about 2—3/4 inches

long and 1—7/8 inches in diameter.      The external surface is made of a corrosion

resistant stainless steel with an internal magnetic shield made of low carbon

steel.    The PFTD—10 device is secured to the fuel line by a single metal clamp

that goes around the middle of the device.      Thé CFTD—2 is a magnetic

rectangular shaped stainless steel device approximately seven (7)       inches in

length.     The CFTD—2 device is secured to the fuel line by two clamps at each

end of the device.     According to the manufacturer,   the devices should be

positioned on the fuel line as close to the carburetor or fuel injector as

possible.     The device‘s installation instructions are shown in the Appendix.



v.        DISCUSSION

          Ferrara International Environmental Products Co.,   Inc.   claims that the

Fuel Treatment devices PFTD—10 and CFTD—2,      when installed on a vehicle‘s fuel

line, magnetically treats fluid hydrocarbon fuels.       The manufacturer stated the

devices are configured so that the fuel passing through the device is treated

by the focalized magnetic field.       The manufacturer also claims that the devices

allow the engine to operate more efficiently and improves fuel economy.         The

ARB did not perform any testing on the devices to substantiate the claims made

by the manufacturer.     However,   it is the staff‘s opinion that the technical

principles underlying the stated function of the devices are not capable of

producing any effects on emissions and fuel economy.


         The ARB previously exempted three similar devices; "Fuel Charger" by J.

A.   Lance Company,   Inc.,   "Fuel—Bnergizer" by the Magnetizer Group,   Inc.   and

"Magna Charger" by B & D Research and Development".        Because of previous

exemptions issued to similar devices with the same operating principle as the

Fuel Treatment Devices PFTD—10 and CFTD—2 and the fact that qualifying for an

exemption is based on not adversely affecting exhaust emissions, the staff

recommends that Ferrara International Environmental Products Co.,         Inc. be

granted an exemption as requested.

                HoW TO INSTALL THE PASSENGER FUEL TREATMENT DEVICE         (PFPTO—10)}


                     1.    Make sure that your ENGINE is OFF and is COOL enough to

                           install the Device safely.

                           Locate your ENGINE FUEL LINE leading in to the
                           carburetor or fuel injector.

                            CLAMP the PFTD—10 around the fuel line.    Make sure that
                            the PFTD—10 is positioned as close as possible to the
                            carburetor or the fuel injector to insure maximum
                            performance.

                            Be sure the PFPTD—10 is placed where it will not
                            interfere with any other lines or wires.

                      5.    Tighten the clamp provided to insure safety,         make sure
                            it is tight, make sure it doe not slight up or down.

               ‘The best qgasoline mileage is obtained by keeping your vehicle in
               proper tune and follow the maintenance schedule recommended by
               the manufacturer.    REDUCTION in gasoline may vary depending on
               year model, make and driver habits.
