                                   of the California Vehicle Code      '

                                  Toyota Racing Development
                                 TRD Performance Air Intake Kit

Pursuant to the authority vested in the Air Resources Board by Sect.ion 27156 of the
Vehicle Code; and

Pursuant to the authority vested in the undersigned by Section 39515 and Section 39516 of
the Health and Safety Code and Executive Order G—02—003;

IT IS ORDERED AND RESOLVED: That the installation of the TRD Performance Air Intake
Kit, manufactured and marketed by Toyota Racing Development, 19001 South Western
Avenue, Torrance,. California 90501, has been found not to reduce the effectiveness of the
applicable vehicle pollution control systems and, therefore, is exempt from the prohibitions
of Section 27156 of the Vehicle Code for the following vehicle applications:         |

For part numbers PTRO3—34072, PTRO3—34100, and PTRO3—34102, the TRD Cold Air Intake
includes a modified air filter housing lid with a Tundra hydrocarbon trap that is permanently
heat staked to the lid of the housing, conical air filter element, an add—on ram air at stock inlet
duct, and air intake tubing from the new air filter housing lid to the stock throttlebody. No
other modifications are required for installation other than the replacement of the stock air
filter housing lid, and intake tubing with Toyota Racing Development‘s unit. The replacement
conical air filter element is designed to replace the stock rectangular element using a molded
plastic adaptor.                                                                           '

For part numbers PTRO3—21101 and PTRO3—52110, the TRD Performance Air Intake Kit
includes a modified air filter housing lid with a stock hydrocarbon trap that is permanently
heat staked to the lid of the housing, an add—on ram air at stock inlet duct, andair intake
tubing from the new air filter housing lid to the stock throttlebody. No other modifications are
required for installation other than the replacement of the stock air filter housing lid, and
intake tubing with Toyota Racing Development‘s unit.

For part number PTRO3—18130, the TRD Performance Air Intake includes a modified upper
and lower air box case, modified air inlet coupler {dirty side of filter), red rubber coupler
between air box and throttlebody, and a TRD flat panel air filter. No other modifications are
required for installation. Stock mass air flow sensor is retained and installed in its stock
location. There is no hydrocarbon trap used for this vehicle application.

For part numbers PTRO3—89100 and PTRO3—35090, the TRD Performance Air Intake
includes a modified upper and lower airbox with a Tundra hydrocarbon trap that is
permanently heat staked to the upper airbox lid, an add—on ram air at stock inlet duct, and
air intake tubing from the new air filter housing lid to the stock throttlebody. No other
modifications are required for installation. Stock mass air flow sensor is retained and
installed in its stock location.

This Executive Order is valid provided that the installation instructions for the TRD
Performance Air Intake Kit will not recommend tuning the vehicle to specifications different
from those submitted by the device manufacturer.

Changes made to the design or operating conditions of the TRD Performance Air Intake Kit,
as exempt by the Air Resources Board, which adversely affect the performance of the
vehicle‘s pollution control system shall invalidate this Executive Order.

This Executive Order shall not apply to any TRD Performance Air Intake Kit advertised,
offered for sale, sold with, or installed on a new motor vehicle prior to or concurrent with
transfer to an ultimate purchaser.

Marketing of the TRD Performance Air Intake Kit using any identification other than that
shown in this Executive Order or marketing of the TRD Performance Air Intake Kit for an
application other than those listed in this Executive Order shall be prohibited unless prior
approval is obtained from the Air Resources Board.

This Executive Order does not constitute any opinion as to the effect the use of the TRD
Performance Air Intake Kit may have on any warranty either expressed or implied by the
vehicle manufacturer.

This Executive Order is granted based on previously submitted emission test data from
Toyota Racing Development (D—425—21 and D—425—22) on a 2008 model year Toyota xB
with a 2.4 liter engine (STYXVO2.4BEB) and a 2007 model yearToyota Tundra with a 5.7
liter engine (7ZTYXTO5.7BEV), both certified to the Low Emission Vehicle II Ultra Low
 Emission Vehicle (LEV II ULEV) emission standards. The emission test results with the
TRD Cold Air Intake installed were below the applicable certification emission standards.
Examination of the OBD II system, showed no effect on the vehicles‘ OBD II system
 operation. The same emission and OBD II test results would be expected with the TRD
 Performance Air Intake Kit installed on the requésted vehicles.

The Air Resources Board reserves the right in the future to review this Executive Order
and the exemption provided herein to assure that the exempted add—on or modified part :
continues to meet the standards and procedures of Title 13, California Code of .
 Regulations, Section 2222, et seq.

THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION,:
ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE _
AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING
ANTI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE TRD
PERFORMANCE AIR INTAKE KIT.

No claim of any kind, such as "Approved by the Air Resources Board", may be made with
respect to the action taken herein in any advertising or other oral or written communication.:

Violation of any of the above conditions shall be grounds for revocation of this order. The
order may be revoked only after a ten—day written notice of intention to revoke the order, in
which period the holder of the order may request in writing a hearing to contest the
proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of
the request and the order may not be revoked until a determination is made after the
hearing that grounds for revocation exist.
