State of California AIR RESOURCES BOARD EXECUTIVE ORDER D-473-13 Relating to Exemptions under Section 27156 of the Vehicle Code Saleen Performance Vehicles Saleen Series VI Supercharger Kit Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Sections 39515 and 39516 of the Health and Safety Code and Executive Order G-02-003; IT IS ORDERED AND RESOLVED: That installation of the Saleen Series VI Supercharger Kit, manufactured by Saleen Performance Vehicles of 1601 West Hamlin Road, Rochester Hills, Michigan 48309, have been found not to reduce the effectiveness of the applicable vehicle pollution control systems, and therefore, the Series VI Supercharger Kit is exempt from the prohibitions in Section 27156 of the Vehicle Code for installation on the following naturally aspirated vehicle applications: Kit Part Number Kit Horsepower Vehicle Application 10-1607-B15058I 475 2007-2009 model year 4.6 liter Ford Mustang with the following test group numbers: 7FMXV05.4VEK 8FMXV05.4VEK 9FMXV05.4VEK ' Note: Supplemental kit 06-1604-B19222, which contains an alternator pulley and intake manifold gaskets, is required when installing the Series VI Supercharger Kit on 2009 model year vehicles. The Saleen Series VI Supercharger Kit consists of an integrated intake manifold with a Lysholm 2.3L Twin Screw supercharger, intercooler, water pump, a reprogrammed powertrain control module, and assorted parts to complete the installation. The supercharger kit is driven by the stock 6.57 inch diameter crankshaft pulley and reuses the original equipment throttle body. The 475 horsepower Series VI Supercharger Kit is rated at a maximum boost of 6.5 pounds per square inch and utilizes a 3.88 inch diameter pulley. This kit uses new fuel injectors, air inlet duct, and air box lid. An original equipment hydrocarbon absorber is purchased from the Ford supplier of this part and is installed in the same location of the air box lid as the original hydrocarbon absorber. .

This Executive Order is granted based on emissions tests submitted by Saleen Performance Vehicles in certifying their supercharged 2009 model year Saleen S281 (4.6 liter engine) and S302 (5.0 liter engine) models as small volume new vehicles (E.O. A-324-0025, test group 9S3XV05.OJDC Low Emission Vehicle (LEV) II LEV). Saleen Performance Vehicles determined that the supercharged Saleen S302 Extreme model, which is a 5.0 liter modified version of the 4.6 liter original equipment engine, was the worst case vehicle for emission testing. The final configuration of the 2007-2009 model year 4.6 liter Ford Mustang equipped with the Saleen Series VI Supercharger Kit will be the same as the Saleen S281 Supercharged vehicle. The certification emission results and exhaust emission standards are shown below (in grams per mile): FTP NMOG CONOX HCHO Standards, 50K 0.075 3.4 0.05 0.015 Emission results 0.037 2.2 0.04 NIA Standards, 120K 0.090 4.2 0.07 0.018 Emission results 0.045. 2.9 0.05 NIA US06 ISC03 NMHC+NOx CO Standards, 4K 0.14 10.20 8.0 12.7 Emission results 0.1 1 10.01 6.5 / 0.5 The emission test results submitted for new vehicle certification have been accepted as representative of emissions in the modified configuration and were below the applicable certification standards. Examination of the OBD II system in the 2009 model year supercharged Saleen vehicles showed the Saleen Series Vl Supercharger Kit does not affect OBD II system operation. If evidence provides the Air Resources Board with reasons to suspect that the Saleen Series VI Supercharger Kit will affect the durability of the emission control system, Saleen Performance Vehicles shall be required to submit durability data to show that the durability of the vehicle emission control system is not, in fact, affected andlor that the add-on or modified parts demonstrate adequat8'burability. This Executive Order is valid provided that installation instructions for the Saleen Series VI Supercharger Kit do not recommend tuning the vehicle to specifications different from those of the vehicle manufacturer. Changes made to the design or operating conditions of the Saleen Series VI Supercharger Kit, as exempt by the Air Resources Board, which adversely affect the performance of the vehicles' emission control system, shall invalidate this Executive Order. Marketing of the Saleen Series VI Supercharger Kit using identification other than that shown in this Executive Order or for an application other than that listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. This Executive Order shall not apply to any Saleen Series VI Supercharger Kit advertised, offered for sale, sold with, or installed on a motor vehicle prior to or concurrent with transfer to an ultimate purchaser. This Executive Order does not constitute any opinion as to the effect the use of the Saleen Series VI Supercharger Kit may have on any warranty either expressed or implied by the vehicle manufacturer. No claim of any kind, such as "Approved by the Air Resources Board," may be made with respect to the action taken herein in any advertising or other oral or written communication. In addition to the foregoing, the Air Resources Board reserves the right in the future to review this Executive Order and the exemption provided herein to assure that the exempted add-on or modified part continues to meet the standards and procedures of California Code of Regulations, Title 13, Section 2222, et seq. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTI-POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF SALEEN PERFORMANCE VEHICLES' SERIES VI SUPERCHARGER KIT. Violation of any of the above conditions shall be grounds for revocation of this Executive Order. The Executive Order may be revoked only after a ten day written notice of intention to revoke the Executive Order, in which period the holder of the Executive Order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request, and the Executive Order may not be revoked until a determination is made after the hearing that grounds for revocation exist.
