                        Relatlng to Exemptlons Under Section 27156
                                   of the CallfornlaVehicle Code

                                 Bully Dog Technologies
                 50 State GT Diesel (part no. 40425), Tune Version 1. 1 .4.O

  Pursuant to the authorlty vestedin the Air Resources Board by Sectlon 27156 of the
 Vehicle Code and                               —              .            .

  Pursuant to the authorlty vested in the undersxgned by Sectlon 39515 and Sect;on
  39516 of the Health and Safety Code and Executlve Order G— 14012;                ‘

  IT IS ORDERED AND RESOLVED: That the mstalla‘uon of the 50 State GT Dlesel
  manufactured and marketed by Bully Dog Technologies 2839 Hwy 89, American Falls,
  ID 83201, has been found not to reduce the effectiveness of the applicable vehicle
  pollution control systems and, therefore, is exempt fromthe prohibitions of Section —
  27156 of the Vehicle Code for 1999—2010 plck-uptrucks equipped with 8.0 liter Ford
  dlesel engines.

  The 50 State GT Diegelisan engine programmer installed via connection to the on—
 board diagnostic connector. Each device has four user—selectable power levels to be
  installed near the driver to allow. selectlon of performance optlons Data files cannot be
  modlfled by the end . user.                                                         .

  This Executive Order is valid provided that the installation instructions for the 50 State
  GT Diesel will not recommend tuning the vehlcle to. specnflcatlons dlfierent from those of
  the vehicle manufacturer.                 .                    .

  Changes made to the design or operatmg condltlons of the 50 State GT Dissel, as
  exempt by the Air Resources Board, which adversely affect the performance of the
  vehicle‘s pollution control system shall invalidatethis Executive Order.

  Marketing of the 50 State GT Diesel using any identification other than that shown in
  this Executive Order or marketing of the 50 State GT Diesel for an application other
  than those listed in this Executive Order shall be prohibited unless prior approval is _
  obtained from the Air Resources Board.

  This Executive Order does not constitute ahy opinion as to the effeot the use of the
  50 State GT Diesel may have on any warranty either expressed or implied by the
  vehicle manufacturer.

 _ This Executive Order is granted based on engineering evaluation and comparative
  Cold—Start Federal Test Procedure test, Supplemental Féderal Test Procedure test,
_ steady—state tests, and On—Board Diagnostic II (OBD II) system test conducted at an


 independent laboratory using a 2007 model—year 6.0L diesel Ford F—350 pick—up truck
 (7ZFMXA06.OAED).

 Installation of the 50 State GT Diesel shall not block or prohibit the communication of all
 required emission related messages from the vehicle‘s OBD II system to a scan tool
 used for the Smog Check Inspection program in California.                   |

The ARB reserves the right in the future to review this Executive Order and the
exemption provided herein to assure that the exempted add—on or modified part
continues to meet the standards and procedures of Title 13, California Code of
Regulations, Section 2222, et seq. Further, if test results or other evidence provides the
ARB with reason to suspect that the 50 State GT Diesel will affect the durability of
emission control systems, Bully Dog Technologies shall be required to submit durability
data to show that the durability of vehicle emission control systems are not, in fact,
affected and/or that the add—on or modified part demonstrates adequate durability.

THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION,
ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE
AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING
ANTI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE BULLY DOG
TECHNOLOGIES 50 STATE GT DIESEL.

No claim of any kind, such as "Approved by the Air Resources Board", may be made
with respect to the action taken herein in any advertising or other oral or written
communication.

 Violation of any of the above conditions shall be grounds for revocation of this order.
 The order may be revoked only after a ten—day written notice of intention to revoke the
order, in which period the holder of the order may request in writing a hearing to contest
 the proposed revocation. If a hearing is requested, it shall be held within ten days of
 receipt of the request and the order may not be revoked until a determination is made
 after the hearing that grounds for revocation exist.
