—State of California AIR RESOURCES BOARD EXECUTIVE ORDER D—721 Relating to Exemptions.Under‘Sectioh 27156 of the California Vehicle Code Sinister Manufacturing Company, Inc. Sinister Diesel EGR Cooler Pursuant to the authonty vestedin the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authorlty vested in the undersigned by Section 39515 and Section 39516 of the Health and Safety Code and Executive Order G—02—003; IT IS.ORDERED AND RESOLVED: That the installation of the Sinister Diesel EGR Cooler, manufactured and marketed by Sinister Manufacturing Company, Inc., 2025 Opportunity Drive, Roseville, California 95678, has beenfound not to reduce the effectiveness of the appllcable vehicle pollution control systems and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for following trucks equipped with Ford dlesel englnes — Model Year— ModeI'Type - » Engine — Kit Part Number — | — Displacement — Excursion,F—250, 2004—2009 . | F—350, E—350, E—450, |6.0 L.. ____ | SMC—EGRCOOLER—80—04 —__| E—Super Duty _ | 2006—2009 F—250, F—350 6.4 L SMC—EGRCOOLER—64—HOR :_| SMC—EGRCOOLER—64—VER 2011—2013 : F—250, F—350, F—450 6.7—L .SMC—EGRCOOLER—67P The Sinister Diesel EGR Cooler is a direct replacement stainless steel cooler that uses a series of seven stainless steel interior tubes for EGR cooling. ‘The modified part requires no modifications for installation and bolts to stock connecting ports without any modifications to the stock connecting ports. The Sinister Diesel EGR Cooler has no mechanical or electrical user adjustments. No changes are made to any component of the stock engine for installation, including engine calibration. This Executive Order is valid provided that the installation instructibns for the Sinister Diesel EGR Cooler will not recommend tuning the vehicle to specifications different from those of the vehicle manufacturer. Changes made to the design or operating‘conditioné of the Sinister Diesel EGR Cooler — as exempt by the Air Resources Board, which adversely affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order.

2. Marketing of the Sinister Diesel EGR Cooler using any identification other than that shown in this Executive Order or marketing of the Sinister Diesel EGR Cooler for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. This Executive Order does not constitute any opinion as to the effect the use of the — Sinister Diesel EGR Cooler may have on any warranty either expressed or implied by the vehicle manufacturer. This Executive Order is granted based on an engineering evaluation and information supplied by Sinister Manufacturing Company, Inc. on the Sinister Diesel EGR Cooler. Comparisons made between the stock and modified part demonstrated similarity in . material type, port size, and design. The Air Resources Board reserves the right in the future to review this Executive Order and the exemption provided herein to assure that the exempted add—on or modified part continues to meet the standards and procedures of Title 13, California Code of Regulations, Section 2222, et seq. | THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, _ ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTIEPOLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF— THE SINISTER DIESEL EGR COOLER, No claim of any kind, such as "Appfdved bythe Air ResourcesBoard", may be made with respect to the actlon taken herein in any advertising or otheroral or written communication. Violation ofany of the above conditions shall be grounds for revocation of this order. The order may be—revoked only after a ten—day written notice of intention to revoke the order, in which period the holder of the order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request and the order may not be revoked until a determination is made after the Kearing that grounds for revocation exist.
