                                       of the Vehicie Code

                                      "AUTOMATIC FUEL REGULATOR®

WHEREAS, Vehicle Code Section 27156 and Title 13 Callfornia Code of
Regulations (hereafter "CCR") Section 2222(e), authorlze the Callfornia Air
Resources Board (ARB) and its Executive Offlcer to exempt add—on ‘and
modified parts from the. prohibitions of Vehlcle Code Section 27156.

WHEREAS, Cagle Corporation has applied to the ARB for—exemption from the
prohibitlons of Vehicle Code Section 27156 for the "Automatic Fue!
Regulator".

WHEREAS, pursuant to the authority:— vested in the Executive Officer by Health
and Safety Code Section 39515 and                     in the Chlef, Moblle Source Division by
Health and Safety Code Section 39516 and Executive Order G—45—5, the Alr
Resources Board finds:

     1.   | The "Automatic Fueli Regulator" is an add—on device that                             is
           connected to the carburetion system in a motor vehicle.

     2.    The "Automatic Fuel Rebulator“                         Is a dlaphragm—type vacuum
           modulated, downstream pressure regulator which is designed to be
            Installed In—iine between the fue! pump and carburetor float bow!l.
           Fue! pressure to the carburetor float bowi.!s determined by the
           Intake manifold vacuum.  The "Automatic Fue! Regulator" is being
           distributed under three models:— Automotive, Competition, and
          _Turbo. All three models fall within the Ilmltatlons of this
           exemption.

          —   The "Automatié Fue! Regulator" by being installed with the
              carburetion system alters the orlginal design of a motor .vehicle
              poliution control system.

              The “AutOmatIc Fue! Regulator" is a device subject to the
              prohibltions of Vehicie Code Section 27156 and an add—on part as
              defined by 13 CCR Section 1900(b)(1).

              The "Automatic Fue! Regulator" does not reduce the effectiveness
              of any required motor vehiclie poliution control device.

              The Air Resources Board,    in the exercise of technical   judgment,   is
              aware of no basls on which the "Automatlic Fuel Regulator"      will
              provide an Increase In fue! economy.

              it has not been determined what effect use of the "Automatic Fuel
              Regulator" may have on any warranty, elther expressed or Implied,
              by the manufacturer of a motor vehtcle on which the device is
              Instal led.

              The "Automatlic Fue! Regulator" is not a certified motor vehicle
              pollution control device pursuant to Health ‘and Safety Code
              Section 43644.              .

              The Alr Resources Board by granting an exemption to Cagle
              Corporation for the "Automatic Fue! Regulator" does not recommend
              or endorse In any way the "Automatlec Fuel Reguiator" for emlsslons
              reductlon, fuel economy, or any other purpose

~1T IS HEREBY RESOLVED that the "Automatlie Fuel Regulator" is exempt from the
 prohibitions of Vehicle Code Section 27156 for instaliation on 1983 and
 earliler model—year vehicles subject to the following. conditions:

     1.       This exemption shall not apply to any device, apparatus, or
              mechanism advertised, offered for sale or sold with, or      installed
              on, a motor vehicie prior to or concurrent with transfer to an
              uitimate purchaser

              No changes are permltted to the device as described in the
              application for exemption.  Any changes to the device, applicable
              mode! year, or other factors addressed in this order must be
              evaluated and approved by the Alr Resources Board prior to
              marketing in California.                            —

              MarketIng of this device using an Identification other than that
              shown in this Executive Order or marketing of this device for an
              application other than those listed In this Executive Order shal!
              be prohliblted untess prior approval is obtained from the Air
              Resources Board.   Exemption of this product shail not be construed
              as an exemption to sell, offer for sale, or advertise any
              component of the product as an individual device.

     4.   Any oral or. written references to this Executive Order or Its
          content by Cagle Corporation,        Its princlipals, agents, employees, .
          distributors, dealers, or other representatives must include the
          disciaimer that the Executive Order or the exemption it provides
          is not an endorsement or approval of any fuel economy or emissions®
          reduction claims for the "Automatlc Fue! Regulator" and is only a
          finding that the device        is exempt from the prohibitions of Vehicie
          Code Section 27156.

Violation of any of the above conditions shall be grounds for revocation of
this order.   The order may be revoked only after ten day written notice of °
Intentlon to revoke the order, In which period the holder of the order may
request in writing a hearing to contest the proposed revocation.   Iif a
hearing is requested, It shall be heid within ten days of recelpt of the
request and the order may not be revoked untll a determination after hearing
that grounds for revocation exist.                    (

Executlve Order D—75—10, dated Aprii 23, 1987, is hereby rescinded and of no
further force and effect.                            ‘

                                   SUMMARY



      Cagle Corporation has requested an update of their existng exemption,

Executive Order (E.0.) No. D—75—10, from the prohibitions    in Vehicle Code

Section 27156 for their "Automatic Fue! Regulator".    This device was

originalily known as the "Cagle Mark   11 Automatic Fue! Control" device.    The

Cagle Corporation   is requesting the Air Resources Board (ARB) to update E.0.

No. D—75—10 to include 1988 and older modeléyear vehicles that are powered

by gasolIne engines with conventlonal carburetors and mechanlcal or

electrical fue! pumps with and without fue!    recirculation systems.    E.0. No.

D—75—10 covered vehlcles with the same specifications for 1987 and oider

model—years.

  ‘   Based on previous emissions tests performed on 1979 model—year

vehicies, and an engineering evaluation of 1979 through 1988 model—year

vehicle fue! systems,   the staff has concluded that the Cagle "Automatic Fue!

Regulator" will have no adverse effect on emissfons from applicable 1988

model—year automobiles.

      The staff recommends granting Cagle‘s request to update E.0. No. D—75—

10 to include 1988 model—year vehlcles equipped with conventional

carburetors.

1.    1NTRODUCT I ON

      Cagle Corporation of Box 2536, Rolling Hills, Callifornia 90274

requested an update of the existing ARB E.0. No, D—75—10.         The applicant

requested that the exemption from the prohibitiqgns in Vehicle Code Section

27156 for their "Automatic Fuel Regulator®" devflée, previously known as the

"Cagle Mark    11 Automatlic Fuel Control" device, be updated to Include the

1988 and older model—year vehicles which are powered by gasoline engines

with conventional carburetors and mechanlcal or electrical fuel pumps with

and without fue!       recirculation systems.   E.0. No. D—75—10 exempts 1987 and

cider model—year vehicles of the same specifications.



11.   CONCLUS ION

      Previous ARB confirmatory emissions tests showed that the use of the

Cagle "Automatic Fue! Regulator" device did not have an adverse effect on

the exhaust emission control system of specified 1979 model—year vehicles.

An exemption from the Vehicies Code for 1979 and older mode!l—year vehicies

was granted.

      The manufacturer was granted updates of the E.0.      to   Include applicable

1980 through 1987 model—year vehicles on the basls that the fue!        systems on
