              Relating to Exemptions under Section 27156
                          of the Vehicle Code


                       STARLIGHT PRODUCTS CcoRP.
            "CARBURETOR FUEL AND PULSATION CONTROL DEVICE"

Pursuant to the authority vested in the Air Resources Board by Section
27156 of the Vehicle Code; and

Pursuant to the authority vested in the undersigned by Sections 39515 and
39516 of the Health and Safety Code and Executive Order G—45—5;

IT IS ORDERED AND RESOLVED: That the installation of the "Carburetor
Fuel and Pulsation Control Device" manufactured by Starlight Products
Corp., Box 1046, Monrovia, California 91016 has been found to not reduce
the effectiveness of required motor vehicle pollution control devices
and, therefore, is exempt from the prohibitions of Section 27156 of the
Vehicle Code for 1979 and older model—year motor vehicles equipped with
gon*egtgonal carburetors. Diesel and fuel injection engines are not
included.

This Executive Order is valid provided that installation instructions
for this device will not recommend tuning the vehicle to specifications
different from those listed by the vehicle manufacturer.

Changes made to the design or operating conditions of the device, as
exempted by the Air Resources Board, that adversely affect the per—
formance of a vehicle‘s pollution control system shall invalidate
this Executive Order.

Marketing of this device using an identification other than that shown
in this Executive Order or marketing of this device for an application
other than those listed in this Executive Order shall be prohibited unless
prior approval is obtained from the Air Resources Board.

This Executive Order does not constitute any opinion as to the effect
@hat the use of this device may have on any warranty either expressed or
implied by the vehicle manufacturer.

THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION,
APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF
ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY
ALLEGED BENEFITS OF THE "CARBURETOR FUEL AND PULSATION CONTROL DEVICE".

No claim of any kind, such as "Approved by Air Resources Board" may be made
with respect to the action taken herein in any advertising or other oral
or written communication.                         '

Section 17500 of the Business and Proféssions Code makes untrue or mis—
leading advertising unlawful, and Section 17534 makes violation punishable
as a misdemeanor.

Section 43644 of the Health and Safety Code provides as follows:

     "43644.   (a) No person shall install, sell, offer for sale, or
     advertise, or, except in an application to the state board for
     certification of a device, represent, any device as a motor vehicle
     poliution control device for use on any used motor vehicle unless
     that device has been certified by the state board. No person shall
     sell, offer for sale, advertise, or represent any motor vehicle
     pollution control device as a certified device which, in fact, is
     not a certified device.   Any violation of this subdivision is a
     misdemeanor."

Any apparent violation of the conditions of this Executive Order will be
submitted to the Attorney General of California for such action as he
deems advisable.                                    >

                          Staff Report

             Evaluation of Starlight Products Corp.
          Carburetor and Fuel Pulsation Control Device"
      in Accordance with Section 2222, Title 13 of the
                 California Administrative Code


Introduction

Starlight Products Co., Monrovia, California 91016 has submitted an

application (see Appendix A) requesting an exemption from Sectfon

27156 of the California Vehicle Code for its "Carburetor Fuel and

Pulsation Control Device" for installation on all 1979 and older

model vehicles equipped with conventional carburetor systems

except for the following:

     a)     fuel injection gasoline powered vehicles

     b)     diesel vehicles

Section 27156 of the Vehicle Code prohibits the installation, sale

or advertisement of any device or mechanism which alters the

performance or design of the vehicle‘s emission control systems.

The Air Resources Board is empowered to exempt any device from

this prohibition if a finding shows the device will not reduce

the effectiveness of the emission control system.


11.   System Description

      The "Carburetor Fuel and—Pulsation Control Device" consists of a

      metal chamber installed in the fuel line which has two diaphrams

      and springs designed to absorb fuel pulsations caused by the fuel

      pump.   The diaphrams consist of a material manufactured by

      Dupont called "Fairprene".   See Exhibit B for specifications

      and Exhibit C for a cross section of the device.    An additional

      claimed benefit is that under certain conditions the device will
      indicate potential fuel pump problems.


IH. Engingering Evaluation

      After examining the device, and an engineering evaluation, the staff

      came to the conclusion that it would have no effect on emissions.


IV.   Applicant‘s Claims

      The applicant has agreed to discontinue previous mileage and

      other claims and has submitted advertising material (Exhibit D)

      which is within acceptable lTimits.   The staff believes that any

      benefits would be minimal.


Recommendation

Based on an engineering evaluation and the information submitted

by the applicant, the staff recommends that Starlight Products

Corporation be granted an exemption for‘the "Carburetor Fuel and

Pulsation Control Device" from the prohibitions of Vehicle Code

Section 27156 for the 1979 and older model vehicles except for

the following:

     1}    Dieset vehicles

     2)    Fuel injection powered gasoline vehicles.
