     Pursuant t o t h e a u t h o r i t y vested i n t h e undersigned by Sections 39515 and
     39516 o f t h e Health and Safety-Code and-Executive Order 6-45-6;

     I T I S ORDERED AND RESOLVED: That t h e I n s t a l l a t i o n o f the add-on Stage I and
     Stage I 1 GN "CHEETAH" Turbocharger Assembly'components manufactured by
     Turbonetics, I n c . o f 650 F l i n n Ave., UniE16; Moorpark, CA 93021, has been
     found not t o reduce t h e e f f e c t i v e n e s s of t h e a p p l i c a b l e v e h i c l e p o l l u t i o n
     c o n t r o l system and, t h e r e f o r e , i s exempt from t h e p r o h i b i t i o n s o f Section
     27156 o f t h e V e h i c l e Code f o r t h e 1986-1987'model-year Buick Regal equipped
     w i t h a Grand N a t i o n a l IT-Type 3.8L V6 turbocharged, i n t e r c o o l e d , f u e l
      i n j e c t e d engine and t h e 1989 Pontiac Turbo Trans Am equipped w i t h t h e same
,-   engine. M o d i f i c a t i o n s t o t h e OEM emission-related p a r t s due t o i n s t a l l a t i o n
     o f t h e Stage 1/11 GN "CHEETAH" Turbocharger Assembly include a hose adapter
     f o r t h e stock a i r mass sensor hqse due t o t h e r e - c o n f i g u r a t i o n o f t h e
     compressor i n l e t connection fron) t h e stock a i r mass sensor and r e l o c a t i o n o f
     t h e passenger s i d e p o s i t i v e craqkcase vent l l a t i o n (PCV) breather connect i o n
     due t o t h e r e - c o n f i g u r e d compressor i n l e t connection.

     This Executive Order i s v a l i d provided t h a t i n s t a l l a t i o n i n s t r u c t i o n s f o r
     t h e turbocharger components w i l l , n o t recormend t u n i n g the v e h i c l e t o
     s p e c i f i c a t i o n s d i f f e r e n t from those submitted by Turbonetics, I n c .

     Changes made t o t h e design o r o p e r a t i n g c o n d i t i o n s o f the turbocharger
     components, as exempt by t h e A i r Resources Board, which adversely a f f e c t the
     performance o f a v e h i c l e ' s p o l l u t i o n c o n t r o l system s h a l l i n v a l i d a t e t h i s
     Executive Order.

     Marketing o f these turbocharger components u s i n g any i d e n t i f i c a t i o n o t h e r
     than t h a t shown i n t h i s Executive Order o r marketing o f these turbocharger
     components f o r an a p p l i c a t i o n o t h e r than those l i s t e d i n t h i s Executive
     Order s h a l l be p r o h i b i t e d unless p r i o r approval i s obtained from t h e A i r
     Resources Board.

     This Executive Order does n o t c o n s t i t u t e any o p i n i o n as t o t h e e f f e c t t h e
     use o f t h e turbocharger components may have on any warranty e i t h e r expressed
     o r i m p l i e d by t h e v e h i c l e manufacturer.

This Executive Order i s granted based on t e s t r e s u l t s v e r i f y i n g t h a t t h e
turbocharger i s n o t f u n c t i o n a l i d u r i n g the CVS-76 Federal Test Procedure
(FTP) d r i v i n g cycle. However: t h e ARB f i n d s t h a t r e a s o n a ~ l egrounds e x i s t
t o b e l i e v e t h a t use of t h e turbocharger components may a2versely a f f e c t
emissions of motor v e h i c l e s when o p e r a t i n g under c o n d i t i o n s o u t s i d e t h e
parameters o f t h e p r e v f o u s l y p r e s c r i b e d t e s t procedures. Accordingly, t h e
ARB reserves t h e r i g h t t o conduct a d d i t i o n a l emission t e s t s , i n t h e f u t u r e ,
as such t e s t s are developed, t h a t w i l l more adequately measure emissions
from a l l c y c l e phases. I f such t e s t r e s u l t s demonstrate t h a t t h e
turbocharger components adversely a f f e c t s emissions during o f f - c y c l e
c o n d i t i o n s (defined as those - c o n d i t i o n s which a r e beyond the parameters of
t h e Cold-Start CVS-75 Federal Test Procedure), t h i s Executive Order s h a l l be
 e f f e c t i v e l y rescinded as o f t h e date t h e t e s t r e s u l t s are v a l i d a t e d .
 Further, I f such t e s t r e s u l t s o r o t h e r evidence provides the ARB w i t h reason
 t o suspect t h a t t h e turbocharger components w i l l a f f e c t the d u r a b i l i t y o f
 t h e emission c o n t r o l system, Turbonetics, I n c . s h a l l be r e q u i r e d t o submit
 d u r a b i l i t y d a t a t o show t h a t t h e d u r a b i l i t y o f t h e v e h i c l e emission c o n t r o l
 system i s not, i n f a c t , affected andlor t h a t t h e add-on cr m o d i f i e d p a r t
 demonstrates adequate d u r a b i l i t y .

I n a d d i t i o n t o t h e foregoing, t h e ARB reserves t h e r i g h t i n t h e f u t u r e t o
review t h i s , E x e c u t i v e Order and t h e exemption provided h e r e i n t o assure t h a t
t h e exempted add-on o r m o d i f l e d p a r t continues t o meet the standards and
procedures o f T i t l e 13, C a l i f o r n i a Code o f Regulations s e c t i o n 2222 e t seq.

APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF
CLAIMS OF THE APPLICANT CONCERNING ANTI-POLLUTION BENEFITS OR ANY ALLEGED
BENEFITS OF TURBONETICS, INC. ' S STAGE 1/11 GN "CHEETAHn TURBOCHARGER
COMPONENTS.

Section 17500 o f t h e Business and Professions Code makes untrue o r
misleading a d v e r t i s i n g u n l a w f u l , and Section 17534 makes v i o l a t i o n
punishable as a misdemeanor.

Section 43644 o f t h e H e a l t h and S a f e t y Code provides as f o l lows:

       "43644, (a) No person s h a l l i n s t a l l , s e l l , o f f e r f o r sale, o r
       advertise, or, except i n an a p p l i c a t i o n t o t h e s t a t e board f o r
       c e r t i f i c a t i o n o f a device, represent, any device as a motor v e h i c l e
       p o l l u t i o n c o n t r o l device f o r use on any used motor v e h i c l e unless t h a t
       device has been c e r t i f i e d by t h e s t a t e board. No person s h a l l s e l l ,
       o f f e r f o r sale, a d v g r t i s e , o r represent any motor v e h i c l e p o l l u t i o n
       c o n t r o l device as a i c e r t l f i e d device which, i f f a c t , i s n o t a c e r t i f i e d
       device. Any v i o l a t i o n of t h i s subdivision i s a misc~meanor."
