K & N FILTERCHARGER INJECTION PERFORMANCE KIT Pursuant to the authority vested in the Air Resources Board (ARB) by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Sections 39515 and 39516 of the Health and Safety Code and Executive Order G—45—5; IT IS ORDERED AND RESOLVED: ‘That the installation of the K & N Filtercharger Injection Performance Kit, manufactured by K & N Enginerring, Inc., P. 0. Box 1329, Riverside, California 92502, has been found not to reduce the effectiveness of the applicable vehicle pollution control system and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for the following vehicle applications: K&IN Part Numbey Velicle Aprlicction 57—5005 1986—88 1.3 liter Mazda RX—7 57—5006 1986—88 1.3 liter Mazda RX—7 Turbo 57—5000 1988—89 1.6 liter Mazda 323 GT & GTX 57—5001 1990—93 1.6 liter Mazda MX—5 Miata 57—2508 1991—92 1.6 liter Mercury Capri 57—6001 1990—93 3.0 liter Nissan 300ZX% 57—6000 1989—93 2.4 liter Nissan 2405X 57—9005 1986 1/2—93 3.0 liter Toyota Supra 57—9004 1987—93 3.0 liter Toyota Supra Turbo This Executive Order is valid provided that installaticn~ instructions for this K & N Filtercharger Injection Performance Kit will not recommend tuning the vehicle to specifications different from those suctitted by K & N Engineering, Inc. Changes made to the design or operating conditions of tr:s K & N Filtercharger Injection Performance Kit as exempt by t—s ARB, which adversely affect the performance of a vehicle‘s poilution control system shall invalidate this Executive Order. Marketing of this K & N Filtercharger Injection Perforzmrance Kit using any identification other than that shown in this Executive Order or marketing of this K & N Filtercharger Injection Performance Kit for an application other than those listed in this Executive Order shall be prolibited unless prior approval is obtained from the ARB. Exemption of the K & N Filtercharger Injection Performance Kit shall not be construed as exsnttior to sell, offerz for sale, or advertise any compsonent of the kit as an cniividual device.

K & N ENGINEERING, INC. EXECUTIVE ORDER D—269—1 K & N FILTERCHARGER INJECTION PERFORMANCE KIT (Page i of 3) This Executive Order is granted based on a determination that the device would not show an adverse effect in emissions if tested using the Cold—Start CVS—75 Federal Test Procedure. However, the ARB finds that reasonable grounds exist to believe that use of the K & N Filtercharger Injection Performance Kit may adversely affect emissions of motcor vehicles when operating under conditions outside the parameters of the previously prescribed test procedures. Accordingly, the ARB reserves the right to conduct emission tests, in the future, as such tests are developed, that will more adequately measure emissions from all cycle phases. If such test results demonstrate that the K & N Filtercharger Injection Performance Kit adversely affects emissions during off—cycle conditions (defined as those conditions which are beyond the parameters of the Cold—Start CVS—75 Federal Test Procedure), this Executive Order shall be effectively rescinded as of the date the test results are validated. Further, if such test results or other evidence provides the ARB with reason to suspect that the K & N Filtercharger Injection Performance Kit will affect the durability of the emission control system, K & N Engineering, Inc. shall be required to submit durability data to show that the durability of the vericle emission control system is not, in fact, affected andj/or that the add—cn or modified part demonstrates afincguats dursability. In addition to the fcregoing, the ARB reserves the rigctt in the future to review this Executive Order and the exemption provided herein to assure that the exempted add—on or modified part continues to meet the standards and procedures of Title 13, California Code of Reqgulations section 2222 et seq. This Executive Order does not constitute any opinion as to the effect the use of this K & N Filtercharger Injection Performance Kit may have on any warranty either expressed or implied by the vehicle manufacturer. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATICN, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR —ESOURCES BOARD OF CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENZFTITS OR ANY ALLEGED BENEFITS OF THE X 4 N ENGINEERING, INC.‘S K & N FILIZE®CHARGER INJERCTION PERFORMANCE KIT. No claim of any kind, such as "Approved by the Air Reszurces Board" may be made with resrect to the action taken herein in any safvertising or other oral or written communication.

The order may be revoked only after ten iday written notice of intention to revoke the order, in which period the hoider of the order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request and the order may not be revoked until a deternination after the hearing that grounds for revocation exist.
