State of California AIR RESOURCES BOARD EXECUTIVE ORDER D—727—2 Relating to Exemptions Under Section 27156 of the California Vehicle Code Mountune LLC MP215 Upgrade Package and the MP275 Performance Upgrade Kit Pursuant to the authority vested in the Air Resources Board (ARB) by Vehicle Code (VC) Section 27156; and Pursuant to the authority vested in the undersigned by Section 39515 and Section 39516 of the Health and Safety Code and Executive Order G—14—012; IT IS ORDERED AND RESOLVED: That the installation of the MP215 Upgrade Package and the MP275 Performance Upgrade Kit, manufactured and marketed by Mountune LLC, 11251 Young River Avenue, Fountain Valley, California 92708, has been found not to reduce the effectiveness of the applicable vehicle pollution control systems and, therefore, is exempt from the prohibitions of VC Section 27156 for the MP215 Upgrade Package, applicable to 2014 to 2016 model year Ford Fiesta ST vehicles, originally equipped with a 1.6L turbocharged engine, and the MP275 Performance Upgrade Kit, applicable to 2013 to 2016 model year Ford Focus ST vehicles, equipped with a turbocharged 2.0L engine. The MP215 Upgrade Package, part number 2364—215—AA, includes the following main components: new upper and lower air box, flat panel air filter cartridge, and a new electronic control unit calibration with no user adjustments. Installation of the MP215 Upgrade Package requires the removal of the stock air filter housing, if the stock air filter housing contains the vehicle‘s tune—up & emissions control decal, a replacement decal must be placed in a similar location. The MP275 Performance Upgrade Kit, part numbers 2363—280—AA and 2363—280—BA includes the following main components: Open element air filter, intake air tubing, new intercooler, and a new electronic control unit calibration with no user adjustments. The stock manifold air pressure sensor is retained in its stock location and orientation. Installation of the MP275 Performance Upgrade Kit requires the removal of the stock air filter housing, if the stock air filter housing contains the vehicle‘s tune—up & emissions control decal, a replacement decal must be placed in a similar location. This Executive Order is valid provided that the installation instructions for the MP215 Upgrade Package and the MP275 Performance Upgrade Kit will not recommend tuning the vehicle to specifications different from those submitted by the device manufacturer. Changes made to the design or operating conditions of the MP215 Upgrade Package and the MP275 Performance Upgrade Kit, as exempt by ARB, which adversely affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order.

This Executive Order shall not apply to any MP215 Upgrade Package and the MP275 Performance Upgrade Kit advertised, offered for sale, sold with, or installed on a new motor vehicle prior to or concurrent with transfer to an ultimate purchaser. Marketing of the MP215 Upgrade Package and the MP275 Performance Upgrade Kit using any identification other than that shown in this Executive Order or marketing of the MP215 Upgrade Package and the MP275 Performance Upgrade Kit for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from ARB. This Executive Order does not constitute any opinion as to the effect use of the MP215 Upgrade Package and the MP275 Performance Upgrade Kit may have on any warranty either expressed or implied by the vehicle manufacturer. This Executive Order is granted based on previously submitted emissions and OBD II test data that was generated in support of Executive Orders D—727 and D—727—1. The increase in vehicle coverage does not present changes that would cause an adverse effect on emissions or impair proper function of the OBD II system. The emissions impact for the newly—included vehicles should be similar to those vehicles covered under the existing Executive Orders. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF THE MP215 UPGRADE PACKAGE AND THE MP275 PERFORMANCE UPGRADE KIT. No claim of any kind, such as "Approved by the Air Resources Board", may be made with respect to the action taken herein in any advertising or other oral or written communication. Violation of any of the above conditions shall be grounds for revocation of this order. The order may be revoked only after a ten—day written notice of intention to revoke the order, in which period the holder of the order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request and the order may not be revoked until a determination is made after the hearing that grounds for revocation exist. o—uslef Executed at El Monte, California, this 2[ day of April 2016.
