                 Relating to Exemptions Under Section 20156
                            of the Yehicle Code

                         THE MAGNETIZER GROUP, INC.
                        "FUEL—ENERGIZER®" MODEL AFE—1

WHEREAS, Yehicle Code Section 27156 and Title 13 Califo~:ia Code of
Regulations (hereafter "CCR") Section 2222(e), authoriz: the California Air
Resources Board and its Executive Officer to exempt adc—sn and modifijed
parts from the prohibitions of Yehicle Code Section 2715¢.

WHEREAS, The Magnetizer Group, Inc. has applied to the +#3 for exemption
from the prohibitions of Vehicle Code Section 27156 for the "Fuel—Energizer"
model AFE—1 device.

WHEREAS, pursuant to the authority vested in the Executze Officer by Health
and Safety Code Section 39515 and in the Chief, Mobile lource Division by
Health and Safety Code Section 39516 and Executive Ords* G—45—5, the Air
Resources Board finds:

     1.    The "Fuel—Energizer" model AFE—1 is an add—or sevice that is
          attached to the fuel line in a motor vehicle.

     2.   The fuel line is part of the required motor v:ricle pollution
          control system.

     3.   The "Fuel—Energizer" model AFE—1 is intended ‘sr use with a
          required pollution control system.

     4.   The "Fuel—Energizer" model AFE—1 by being ins:alled in the fuel
          line alters the original design of a motor vericle poliution
          control system.

     5.   The "Fuel—Energizer" model AFE—1 is a device sbject to the
          prohibitions of Vehicle Code Section 27156 an: an add—on part as
          defined by 13 CCR Section 1900(b)(1).

    6.    The "Fuel—Energizer" model AFE—1 does not rec.se the effectiveness
          of any required motor vehicle pollution contr:l device.

    7.    The Air Resources Board, in the exercise of tschnical judgement,
          is aware of no basis on which the "Fuel—Enerq:sr" mode) AFE—1
          will provide either a decrease in emission or in increase in fuel
          economy.

     8.   It has not been determined what effect the uss of the "Fuel—
          Energizer" model AFE—1 may have on any warran:y, either expressed
          or implied, by the manufacturer of a motor ver—cle on which the
          device is installed.

           The "Fuel—Energizer" model AFE—1 is not a certfied motor vehicle
           pollution control device pursuant to Health ar: Safety Code
           Section 43644.

     10.   The Air Resources Board by granting an exemptiza to the The
           Magnetizer Group, Inc. for the "Fuel—Energizer‘ mode} AFE—1 does
           not recommend or endorse in any way the "Fuel—inergizer" model
           AFE—1 for emissions reduction, fuel economy, ct any other purpose.

IT IS HEREBY RESOLYED that the "Fuel—Energizer" model AFZ—1 is exempt from
the prohibitions of Vehicle Code Section 27156 for insta‘lation on 1992 and
earlier model—year vehicles powered with gasoline or diesel internal
combustion engines subject to the following conditions:

     1.    This exemption shall not apply to any device, ipparatus, or
           mechanism advertised, offered for sale or sole with, or installed
           on, a motor vehicle prior to or concurrent wit" transfer to an
           ultimate purchase.

           No changes are permitted to the device as described in the
           application for exemption. Any changes to the device, applicable
           model! year, or other factors addressed in this order must be
           evaluated and approved by the Air Resources Beird prior to
           marketing in California.

           Marketing of this device using an identificatisn other than that
           shown in this Executive Order or marketing of this device for an
           application other than those listed in this Exscutive Order shall
           be prohibited unless prior approval is obtaines from the Air
           Resources Board.  Exemption of this product shall not be construed
           as an exemption to sell, offer for sale, or adsertise any
           component of the product as an individual device.

           Any oral or written references to this Executive Order or its
           content by the The Magnetizer Group, Inc., its principals, agents,
           employees, distributors, dealers, or other representatives must
           include the disclaimer that the Executive Order or the exemption
           it provides is not an endorsement or approval of any fuel economy
           or emissions reduction claims for the "Fuel—Ensrgizer" model AFE—1
           and is only a finding that the device is exemp‘t from the
           prohibitions of Vehicle Code Section 27156.

           No claim of any kind, such as "Approved by the Air Resources
           Board" may be made with respect to the action taken hergin in any
           advertising or other oral or written communication.

Vioelation of any of the above conditfions shall be grouris for revocation of
this order.   The order may be revoked only after a ten—iay written notice of
intention to revoke the order, in which period the holzsr of the order may
request in writing a hearing to contest the proposed revocation.    If a
hearing is requested, it shall be held within ten days of receipt of the
request and the order may not be revoked until a deternination after hearing
that grounds for revocation exist.

Executive Order D—174—1, dated September 19, 1990, is ::perseded and of no
further force and effect.

                                  SUMMARY


       The Magnetizer Group, Inc. (Magnetizer), of P. 0. Box 1000, Point

Pleasant Pike, G@ardenville, PA 18926, has requested to update Executive Order

D—174—1 from the prohibitions in Section 27156 of the California Yehicle Code

for their "Fuel—Energizer" model AFE—1 device.   Executive Order D—174—1

currently exempts the Fuel—Energizer for 1991 and older model—year gasoline and

diesel powered vehicles.   Magnetizer would like to update the exemption to

include 1992 model—year gasoline and diesel powered vehicles.

       The staff recommends adoption of Executive Order D—174—2 granting an

exemption for the Fuel—Energizer for 1992 and older model—year gasoline and

diesel powered vehicles.

I.          OBUCTIO

       The Magnetizer Group, Inc. (Magnetizer), of P. 0. Box 1000, Point

Pleasant Pike, Gardenville, PA 18926, previously received an exemption from the

prohibitions of Vehicle Code Section (VC) 27156 for the "Fuel—Energizer" model

AFE—1 device under Executive Order D—174—1.   Under Executive Order D—174—1, the

device can be used on 1991 and older model—year gasoline and diesel powered

vehicles.   Magnetizer has requested that the exemption for the Fuel—Energizer

be updated to include 1992 model—year vehicles.



II.    CONCLUSTONS
       The Air Resources Board‘s (ARB) staff previously datermined through an

engineering evaluation that the Fuel—Energizer would not adversely affect the

vehicle‘s—exhaust emissions.   Since there are no changes in the size, shape or

operational principle of the device, the staff has no basis upon which to deny

the request of the applicant and concurs that the device will have no adverse

impact on emissions of 1992 and older model—year gasoline and diesel powered

vehicles.



III. RECOMMENDATION
       The staff recommends that the Magnetizer Group, Inc. be granted an

exemption from the prohibitions in California Vehicle Code Section 27156 for

their Fuel—Energizer device and that Executive Order D—174—2 be issued.

IV.    DEVICEDESCRIPTION
       The Fuel—Energizer is a magnetic device which is designed for

installation on fuel lines.     It is oblong shaped, with extended edges on the

sides and consists of two parts each named as magnetizer 1/2 unit.     It is

designed to fit around small diameter fuel lines {less than 1/2") and is held

by two locking ties.     There are two cube magnets with dimensions of 1/2" X 57/8"

X 2—3/8" in each half device.     The device is encased in a plastic coating in

order to hold the magnets in place and prevent the steel plate from corroding.

Appendix A contains an engineering drawing of the device.      No adjustments such

as timing, EGR, fuel metering or any other engine adjustments are included in

the installation instructions.



 v.    DISCUSSION
        Magnetizer claims that when the Fuel—Energizer is installed on a

 vehicle‘s fuel line, it will alter the fon polarities of the fuel resulting in

 improved vaporization, air/fuel mixture, combustion rate, engine performance

 and fuel economy.     The ARB did not perform any testing on the device to

 substantiate the claims made by the manufacturer.     It is, however, the staff‘s

 opinion that the technical principles underlying the stated functions of the

 device are not capable of producing any effects on emissions and fuel economy.

 The ARB has previously exempted two similar devices; "Polarion—X" by AZ

 Industries, Inc. and "Softron model #100 Fluid Conditioner" by Softron

 International, Inc.    The exemptions were granted based on emission tests


and engineering evaluations.   Because of the previous exemptions issued to

similar devices with the same operating principle and the fact that qualifying

for an exemption is based on not adversely affecting exhaust emissions, the

staff recommends that the Magnetizer Group, Inc. be granted an exemption as

requested.
