State of California — AIR RESOURCES BOARD EXECUTIVE ORDER D—544 Relating to Exemptions Under Section 27156 of the Vehicle Code GCA Industries True Flow Air Intake System Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Section 39515 and Section 39516 of the Health and Safety Code and Executive Order G—02—003; IT IS ORDERED AND RESOLVED: That the instaliation of the True Flow Air Intake System, manufactured and marketed by GCA Industries, 16161 N. 81 Street, Scottsdale, Arizona, 85260 has been found not to reduce the effectiveness of the applicable vehicle pollution control system and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for the vehicle applications listed in Exhibit A. The True Flow Air Intake System consist of air intake tubing and a replacement air filter cartridge that is installed in the original air filter housing. This Executive Order is valid provided that the installation instructions for the True Flow Air Intake System will not recommend tuning the vehicle to specifications different from those submitted by the device manufacturer. This Executive Order shall not apply to any GCA Industries‘ True Flow Air Intake System advertised, offered for sale, sold with, or installed on a new motor vehicle prior to or concurrent with transfer to an ultimate purchaser. Changes made to the design or operating conditions of the True Flow Air Intake System, as exempt by the Air Resources Board, which adversely affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order. Marketing of the True Flow Air Intake System using any identification other than that shown in this Executive Order or marketing of the True Flow Air Intake System for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. Exemption of the True Flow Air Intake System shall not be construed as exemption to sell, offer . for sale, or advertise any component of the kit as an individual device. This Executive Order does not constitute any opinion as to the effect the use of the True Flow Air Intake System may have on any warranty either expressed or implied by the vehicle manufacturer. P

This Executive Order is granted based on an engineering evaluation which determined that the — True Flow Air Intake System will have no adverse effect on emissions if tested according to the Cold—Start CVS—75 Federal Test Procedure or the Supplemental Federal Test Procedure. The evaluation also determined that the installation of this product would not affect the vehicle‘s ability to perform its On—Board Diagnostic II monitoring. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF GCA INDUSTRIES‘ TRUE FLOW AIR INTAKE SYSTEM. No claim of any kind, such as "Approved by the Air Resources Board", may be made with respect to the action taken herein in any advertising or other oral or written communication. Violation of any of the above conditions shall be grounds for revocation of this order. The order may be revoked only after a ten—day written notice of intention to revoke the order, in which period the holder of the order may request in writing a hearing to contest the proposed revocation. If a hearing is requested, it shall be held within ten days of receipt of the request and the order may not be revoked until a determination is made after the hearing that grounds for revocation exist. EVALUATION SUMMARY Manufacturer Name: GCA Industries Name of Device: True Flow Air intake Systém Background: GCA Industries of 16161 N. 81 Street , Scottsdale, Arizona, 85260, has applied for an exemption from the prohibitions in Section 27156 of the California Vehicle Code (VC) for the GCA Industries‘ True Flow Air Intake System designed for the vehicle applications listed in Exhibit A. Recommendation: Grant exemption to GCA industries as requested and issue Executive Order D—544. Device Description: GCA Industries‘ True Flow Air Intake System is an air intake system that is specifically designed for installation on the vehicles listed in Exhibit A. The True Flow Air Intake System replaces the air intake tube that is located between the stock air filter box and the engine‘s throttle body housing. The True Flow Air Intake System is constructed out of metal with a powder—coat finish. Eachkit comes with a reusable high flow replacement air filter cartridge that replaces the stock air filter cartridge. The factory air filter housing is retained. To enhance the sound for Honda vehicles, a plug is placed in the square air muffler opening that is located in the interior of the air box lid. No other modifications are necessary for installation. Discussion/Basis for the Recommendation: The Air Resources has previously evaluated and issued VC 27156 for various designs of air intake systems. Most of these systems include an open element air cleaner and a modified intake tubing, which may have a different length and location as the original tubing. In most cases, these systems do not adversely affect emissions and the vehicle‘s on—board diagnostic II (OBD II) systems provided installation of the air intake systems require the reconnection of all sensors and emission control components. In the case of True Flow Air Intake System, the changes are minimal compared to the previously exempted air intake systems. Instead of providing an open—element air cleaner, True Flow Intake System comes with an air filter cartridge only for installation to the original air filter housing. The original plastic intake tubing is replaced with one made of metal but the length and location of the tubing is the same as stock. Based on the True Flow Intake System description and the fact that numerous VC 27156 exemptions have been issued on air intake systems with more extensive modifications, the staff has determined that no adverse effect on emissions will result from the use of this device. Staff also deemed that emission testing and OBD II validation would not be necessary for the evaluation. GCA Industries‘ True Flow Air Intake System meets the requirements for a VC 27156 exemption.
