                    Relatlng to Exemptions under Sections 27156 and 38391
                                           of the Vehlcle Code

                      ' Infern'ational Muffler Company (d.b.a. Cherry’Bomb)
                                 New Aftermarket Catalytic Converters

 WHEREAS, Vehicle Code Sections 27156 and 38395 and Title 13, California Code of                  .
 Regulations (hereafter "CCR") Section 2222(h) authorize the California Air Resources Board
 and its Executive Officer to exempt new aftermarket catalytic converters from the prohlbltlons
 of Vehicle Code Sections 27156 and 38391.

  WHEREAS, pursuant to the authority vested in the Executive Officer by Health and Safety
~ Code Section 39515 and in the Chief of the Mobile Source Operations Division by Health and
— Safety Code Section 39516 and Executive Order G—02—003, the Air Resources Board issued
 Executive Orders D—560—1 and D—560—2 which exempted the International Muffler Company
 catalytic converter series 655000/655500 and 656800/656900, respectlvely, from the
 prohibitions of Vehlcle Code Sectlons 27156 and 38391.

| WHEREAS, sald exemption was granted pursuantto andéubject to the "California Ev'aluation'
 Procedures for New Aftermarket Catalytic Converters," adopted on October25, 2007
 reqUIred by Tltle 13, CCR Section 2222(h).     '

 WHEREAS, International Muffler Company of 2400 Maremont Parkway, Loudon, Tennessee
 37774 has failed to demonstrate proper malfunction indicator light illumination with the
 aforementioned catalytic converterseries as required in section (e)(5)(B) of the “Caln‘orma
 Evaluation Procedures for New Aftermarket Catalytic Converters adopted on
 October 25 2007, within the allowed time period.

 IT' IS HEREBY RESOLVED that Executive Order D—560—1 issued on April 27, 2009, and
 Executive Order.D—560—2 issued on January 7, 2010, are rescinded. International Muffier
 \Company, its agents, and any businesses connected with these products shall cease and .
 desist installation, sale, offer for sale,; and advertisement of the catalytic converters covered — _
 in these Executive Orders in the State of Cahfornla effective the date of signature of
 Executive Order D—560—4.           |                v
