State of California AIR RESOURCES BOARD EXECUTIVE ORDER D—745 Relating to Exemptions Under Section 27156 of the California Vehicle Code ACCEL Performance Group SuperTuner Programmer Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Section 39515 and Section 39516 of the Health and Safety Code and Executive Order G—14—012; IT IS ORDERED AND RESOLVED: That the installation of the SuperTuner Programmer, manufactured by Superchips, Inc., 1790 East Airport Boulevard, Sanford, Florida 32773 and marketed by ACCEL Performance Group, 10601 Memphis Avenue, Cleveland, Ohio 44144, has been found not to reduce the effectiveness of the applicable vehicle pollution control systems and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for the following 1998 and 2015 model year vehicles listed in Exhibit A. The SuperTuner Programmer is a hand held programmer designed to reprogram the FLASH memory chip located in the vehicle‘s ECU module. The stages of enhancement are: transmission only, 87 octane, towing, and performance. Emission—related data files cannot be modified by the end user. This Executive Order is valid provided that the installation instructions for the SuperTuner Programmer will not recommend tuning the vehicle to specifications different from those submitted by the device manufacturer. Changes made to the design or operating conditions of the SuperTuner Programmer, as exempt by the Air Resources Board, which adversely affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order. This Executive Order shall not apply to any SuperTuner Programmer advertised, offered for sale, sold with, or installed on a new motor vehicle prior to or concurrent with transfer to an ultimate purchaser. Marketing of the SuperTuner Programmer using any identification other than that shown in this Executive Order or marketing of the SuperTuner Programmer for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. This Executive Order does not constitute any opinion as to the effect the use of the SuperTuner Programmer may have on any warranty either expressed or implied by the vehicle manufacturer. This Executive Order is granted based on previously submitted emissions and OBD 11 test data that was generated in support of prior Executive Orders. The test vehicles were a 2007 model year 4.6L Ford Mustang, certified to the Low Emission Vehicle II Ultra Low Emission Vehicle (LEV II ULEV) emission standards, with a measured 20 horsepower gain, a 2007 model year 5.4L Ford Shelby GT 500 Mustang, certified to

LEV II LEV emission standards, with a measured 55 horsepower gain, a 2007 model year 5.7L Chrysler 300, certified to LEV II ULEV emission standards, with a measured 20 horsepower gain, a 2009 model year 5.3L. Chevrolet Suburban, certified to LEV II ULEV emission standards, with a measured 10 horsepower gain, a 2006 model year 6.0L Pontiac GTO, certified to LEV 1 ULEV emission standards, with a measured 12 horsepower gain, and a 2011 model year 3.5L Ford F—150, certified to LEV II ULEV emission standards, with a measured 53 horsepower gain, 2008 model year 6.4L Ford F—350 truck LEV II ULEV emission standards, with a measured 75 horsepower gain, 2009 model year 6.7L Dodge Ram 3500 truck LEV II ULEV emission standards, with a measured 100 horsepower gain, 2007 model year 5.9L Dodge Ram 3500 truck with a measured 114 horsepower gain, and 2015 model year 6.6L GM 2500 truck LEV II ULEV emission standards, with a measured 100 horsepower gain. The Air Resources Board reserves the right in the future to review this Executive Order and the exemption provided herein to assure that the exempted add—on or modified part continues to meet the standards and procedures of Title 13, California Code of Regulations, Section 2222, et seq.
