State o f Cal i fo r n i a A I R RESOURCES BOARD EXECUTIVE ORDER D-1-2 Relating t o Exemptions under Section 27156 o f t h e Vehicle Code CONTIGNITRON COMPANY "MODEL 4-8" Pursuant t o t h e a u t h o r i t y vested i n t h e A i r Resources Board by Section 27156 o f the Vehicle Code; and Pursuant t o t h e a u t h o r i t y vested i n the undersigned by Section 39023 o f the Heal t h and Safety Code ; I T I S ORDERED AND RESOLVED: That the i n s t a l l a t i o n o f a "Model 4-8" e l e c t r o n i c i g n i t i o n system manufactured by Contignitron Company has been found by the Board t o n o t reduce t h e effectiveness o f required motor v e h i c l e p o l l u t i o n c o n t r o l devices on 1966 through 1970 model year vehicles w i t h engine displacement of 50 through 140 cubic inches, except Volkswagens and those vehicles equipped w i t h c a p a c i t i v e discharge i g n i t i o n systems, Therefore, vehf c l e s so equipped are exempt from t h e p r o h i b i t i o n s o f Section 271 56 o f t h e Vehicle Code. The "Model 4-8" e l e c t r o n i c i g n i t i o n system consists o f a t r a n s i s t o r i z e d power switching c i r c u i t , e l e c t r o n i c t i m e r c i r c u i t , and c i r c u i t s t o c o n t r o l spark t i m i n g as a f u n c t i o n o f engine speed. This Executive Order i s v a l i d provided t h a t i n s t a l l a t i o n i n s t r u c t i o n s f o r t h i s device w i l l n o t recommend t u n i n g t h e v e h i c l e t o s p e c i f i c a t i o n s d i f f e r e n t than those l i s t e d by t h e v e h i c l e manufacturer. Changes made t o t h e design o r operating conditions o f the device, as o r i g i n a l l y submitted t o t h e A i r Resources Board f o r evaluation, t h a t adversely a f f e c t t h e v e h i c l e ' s p o l l u t i o n c o n t r o l devices s h a l l i n v a l i d a t e t h i s Executive Order. Marketing o f t h i s device using an i d e n t i f i c a t i o n o t h e r than t h a t shown i n t h i s Executive Order o r marketing o f t h i s device f o r an a p p l i c a t i o n other than those l i s t e d i n t h i s Executive Order s h a l l be p r o h i b i t e d unless p r i o r approval i s obtained from t h e A i r Resources Board. This Executive Order does n o t c o n s t i t u t e any opinion as t o t h e e f f e c t t h a t the use o f t h i s device may have on any warranty e i t h e r expressed o r i m p l i e d by the v e h i c l e manufacturer. THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATIOV, ACCREDITATION, OR APPROVAL BY THE A I R RESOURCES BOARD ON ANY CLAIMS OF THE APPLICANT CONCERrIING ANTI-POLLUTION BENEFITS, OR ANY OTHER TYPE OF ENDORSEMENT BY THE A I R RESOURCES BOARD OF ALLEGED BENEFITS OF THE "MODEL 4-8" DEVICE. Sectf on 17500 o f t h e Business and Professions Code makes unlawful, untrue o r misleading advertising, and Section 17534 makes v i o l a t i o n punishable as a misdemeanor. Sections 39130 and 39184 o f t h e Health and Safety Code provide as f o l l o w s : "39130. No person s h a l l i n s t a l l , s e l l , o f f e r f o r sale, o r advertise, or, except i n an a p p l i c a t i o n t o t h e board f o r c e r t i f i c a t i o n o f a device, represent, any device as a motor v e h i c l e p o l l u t i o n c o n t r o l device unless t h a t device has been c e r t i f i e d by t h e board. No person s h a l l s e l l , o f f e r f o r sale, advertise, o r represent any motor vehicle p o l l u t i o n c o n t r o l device as a c e r t i f i e d device which, i n fact,. i s n o t a c e r t i f i e d device. Any v i o l a t i o n o f t h i s s e c t i o n i s a misdemeanor. " "39184. (a) No person s h a l l i n s t a l l , s e l l , o f f e r f o r sale, o r adver- t i s e , or, except i n an a p p l i c a t i o n t o t h e board f o r a c c r e d i t a t i o n o f a device, represent, any device as a motor v e h i c l e p o l l u t i o n c o n t r o l device f o r use on any used motor v e h i c l e unless t h a t device has been accredited by t h e board. No person s h a l l s e l l , o f f e r f o r sale, adver- t i s e , o r represent any motor v e h i c l e p o l l u t i o n c o n t r o l device as an accredited device which, i n fact, i s n o t an accredited device. Any v i o l a t i o n o f t h i s subdivision i s a misdemeanor." "39184. ( b ) Subdivision ( a ) s h a l l n o t preclude any person from i n s t a l - l i n g , s e l l i n g , o f f e r i n g f o r sale, o r a d v e r t i s i n g a device as a motor v e h i c l e p o l l u t i o n c o n t r o l device f o r use on a p a r t i c u l a r c l a s s i f i c a t i o n o f used motor vehicles i f t h e board has found t h a t t h e i n s t a l l a t i o n o f t h e device on t h a t p a r t i c u l a r c l a s s i f i c a t i o n o f used motor v e h i c l e r e s u l t s i n such vehicles meeting t h e s t a t e exhaust emissions standards.
