                           Relating t o Exemptions under Section 27156
                                        of the Vehicle Code
                                        CONTIGNITRON COMPANY
                                     "MODEL 46" AND "MODEL 48"

    Pursuant t o the authority vested i n the A i r Resources Board by Section 27T56 a f
    the Vehicle Code; and
    Pursuant t o the authority vested i n the undersigned by Section 39023 of t h e Health
    and Safety Code;
    IT IS ORDERED AND RESOLVED: That the i n s t a l l a t i o n of a "Model 46" o r "Mode7 48"
    e l e c t r o n i c ignition system manufactured by Conzignitron Company has been found
    by the Board t o not reduce the effectiveness of required motor vehicles pollution
    control devices on 1956 through 1970 modei year vehicles with engine displacement
-   of greater than 200 cubic inches, except those vehicles equipped with capacitive
    discharge ignition systems, and therefore, vehicles so equipped a r e exempt from
    the prohibitions of Section 27156 of the Vehicle Code.
    The "Model 46" and "Model 48" electronic ignition systems consist of a t m n s i s t r r i z e d
    power switching c i r c u i t , electronic timer c i r c u i t , and c i r c u i t s t o control spark
    timing as a function of engine speed.
    This Executive Order i s valid provided t h a t i n s t a l l a t i o n instructions f a r t h i s
    device will not recommend tuning the vehicle to specifications d i f f e r e n t than t h o s ~
    l i s t e d by the vehicle manufacturer.
    Changes made to the design o r operating conditions of the device, as original'ly
    submitted to the Air Resources Board f o r evaluation, t h a t adversely a f f e c t the
    vehicle's pollution control devices s h a l l invalidate t h i s Executf ve Order.
    THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION, OR APPROVAL
    BY THE AIR RESOURCES BOARD OF ANY CLAIMS OF THE APPLICANT CONCENIFIG ANTI-POLLUTION
    BENEFITS. OR ANY OTHER TYPE OF ENDORSEFENT BY THE AIR RESOURCES BOARD OF A U l G E D
    BENEFITS-OF THE "MODEL 46" AND "MODEL 48" DEVICES.
    Section 17500 of the Business and Professions Code makes unlawful, untrue u r mis--
    leading advertising and Section 17534 makes violation punishable a s a misdemeanor.
    Any apparent violation of the conditions of t h i s Executive Order will be submitted-
    to the Attorney General of California f o r such action as he deems advisable.

             Mandatory I n s t a l l a t i o n of an Oxides of Nitrogen Control Device


    I.    Introduction
          On January 22, 1974, the Executive Officer n o t i f i e d Contigni tron
          Company of the termination of the NOx device accreditation of i t s
          "Model 46" and "Model 48" devices due t o non-compliance of the
          fi nanci a1 responsi bi 1i t y c r i t e r i o n of the device accreditation

•         procedures.    On January 26, 1974, Conti gni tron Company submitted a
          request t o t h e Air Resources Board t o be granted an exempt s t a t u s
          r e l a t i v e to the prohibitions of Section 27156 of the Vehicle Code and
          the mandatory i n s t a l l a t i o n o f an accredited NOx device f o r these de-
          vices.   Copies of these l e t t e r s are appended to this report.

    11.   Discussion
          A previous s t a f f evaluation of Conti gni tron Company's application
          f o r accreditation f o r i t s "Model 46" and "Model 48" devices found
          t h a t the application met a l l of the accreditation procedure c r i t e r i a

           except f o r financial responsibility.        Since the Conti gnitron Company
           intends t o market devices under the exempt s t a t u s identical t o those
           marketed as accredited devices, no f u r t h e r s t a f f evaluation is
           required.

    111.   Recommendation
           The s t a f f recomnends t h a t the Contignitron Company be granted an
           exemption from the prohibitions of Section 27156 of the Vehicle Code
           f o r i t s "Model 46" and "Model 48" electronic i g n i t i o n systems.
           I t i s f u r t h e r recommended t h a t 1966-70 model-year vehicles w i t h
0          engine displacements of greater than 200 cubic inch equipped w i t h
           these devices be exempt from the NOx device r e t r o f i t program.

                  This letter is written to acknowledge receipt of your letter of
                  -January 22, 1974, In this 1ette.r you stated that accreditation
                  of the Contignitron System has been withdrawn, and that this action
                  was taken due to Motors Inc. withdrawing as co-applicants.
                   In view of the present status of the NOx Program and fickleness
                  exhibited by the State Air Resources Board, who can blame them.
                  Further let me state that the action.of deaccreditation without
                  due process or opportunity to substitute another qualified organi- .
                  zation or individual and/or provide our own financial statement, -
             %    etc., could cause Contignitron Co. to suffer irreparable damage.
                  ;So as to limit the extent of any such damages and allow continued
                  operation and distribution of our product, it is hereby requested
    ..            that the Contignitron "Equalizer Models 46 & 48If be granted exempt
                  status immediately.
,                 Your expeditious attention to thisrequest is required for continued
                  operation of our facilities and to allow us to meet our present obli-
                  gations and commitments.
