               Relating to Exemptions under Section 27156
                           of the Vehicle Code

                       PALMCO ENGINEERING COMPANY
                            "MONITOR GASAVER"

 Pursuant to the authority vested in the Air. Resources Soard by Snct1on
 27156 of the Vehicle COdL, and

 Pursuant to the authority vested in the undersigned by Section 39023 of
 the Health and Safety Code;

 IT IS ORDERED AND RESOLYED: That the installation of the "Monitor Gasaver"
«distributed by Palmco Engineering Co., 8416 Securs Way, Santa Fe Springs,
California 90670, has been found to not reduce the effectiveness of
motor vehicle po11ut1on control devices and therefore is exempt from the
 prohibitions of Section 27156 of the Vehicle Code for 1976 model—year
 and older model—year vehicles.                       '

 This device consists of a plastic unit installed in the fuel line between    °
  the fuel pump and the carburetor. The unit contains two diaphragms and
  calibrated back up springs designed to absorb the pulsations created in the
. fuel by the fuel pump.

 This Executive Order is valid provided that installation instructions
 for this device will not recommend tuning the vehwc«e-3sperixlcatlons
 different than thoss lTisted by the vehicle manufecture

 Changes made to the design or opsrating conditions of the device, as
 exempted by the Air Resources Board, that adversely affect the por—
 formance of the vehicle‘s pollution control system shall invalidate
 this Executive Order.

Marketing of this device using an 1dent1f1cab1on other than that shown
 in this Executive Order or marketing of this device for an application
 other than those listed in this Evecutive Order shall be prohibited unless
 prior approval is obtained from the Air Resources Board.


This Executive Order does not constitute any opinion asth° effect
 that the use of this device may have on any warranty either expressed or
 implied by the vehicle manufacturer.

THIS EXECUTIVE ORDSER DOES NOT CONSTITUTE ACFRTIFICATIUN ACCREDTTATION,
APPROVAL, OR ANY OTHER TYPE OF EIPURSEVFRT BY THE     ESuURCES BOARD OF
ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—PCLLUTIO“ LENEFITS OR ANY
ALLEGED BENEFITS OF THE "MONITOR GASAVt”" DEVICE.


 No claim of any k]nd, such as "Approved by Air Resources Board" may be made
  with respect to the action taken herein in any advert(s1ng or other oral
~ or written communication.

 Section 17500 of the Business and Professions Code makes unlawful, untrus
 of misleading advertising, and Section 17534 makes violation punishable as
 a misdemeanor.

© Sections 39130 and 39184 of the Health and Safety Code mékes unlawful, untrue
  or misleading advertising, and Section 17534 makes violation punishable as
  a‘misdemeanor.

 Sections 39130 and 39184 of the Health and Safety Code provide as follows

      "39130.   No person shall install, sell, offer for sale, or advertise,
      or, except in an application to the board for certification of a
      device, represent, any device as a motor vehicle pollution control
      device unless that device has been certified by the board.    No
      person shall sell, offer for sale, advertise, or represent any motor
      vehicle pollution control device as a certified device which, in
      fact, is not a certified device. Any violation of this section is
      a misdemanor."                                   .

      "39184.   (a) No person shall install, sell, offer for sale, or adver—
     ~tise, or, except in an application to the board for accreditation of a
      device, represent, any device as a motor vehicle po?]ution control
      device for use on any used motor vehicle unless that device has been
      accredited by the board.  No person shall sell, offer for sale, adver—
      tise, or represent any motor vehicle pollution control dévice as an
      arcredated device which, in fact, is not an accredited device.     Any
      viclation of this subdivision is a misdemeanor."

 Any apparent violation of the conditions of this Executive Order will be
 submitted to the Attorney General of California for such action as he deems
 advisable.

                      Evaluation of Palmco Engineering Co.
                                "Monitor Gasaver"
                  for Exemption from the Prohibitions of
                  Section 27156 of the Motor Yehicle Code


       Introduction

       Palmce Engineering Co., has submitted an application requesting en

       exemption from Section 27156 of the California Motor Vehicle Code

       for the "Monitor Gasaver" (Reference — Exhibit A)}.    Vehicle Code

       Section 27156 prohibits the installation of any device or mechanism

       which reduces the effectiveness of the required emission control

       systems.   This vehicle code section also authorizes the Air Resources

       Board to exempt devices from this prohibition if a finding shows the

       device will not adversely affect the performance of the emission

       control system.     The applicant is requesting the exemption be granted

       for all 1975 and older model—year vehicles.


 11.   System Description
       This device consists of a plastic unit installed in the fuel Hine

       between the—carburetor and the fuel pump.     The unit contains two dia—

       phragms and calibrated back up springs to absorb the pulsattons

       created in the fuel by the fuel pump.


III. System Function

       According to the applicant, the device improves the life of the

       carburetor valve'seat and float and maintains an even float level

       at all times.   In addition the unit will indicate fuel pump pressure.

      \ (See Exhibit B).


IV.    System Evaluation

       The staff is of the opinion that since there is no restriction to the

       flow of fuel, there is no affect on emissions.      The pressure in this

       section of the lTine is approximately 8 1bs./in2;     The diaphragm burst
       pressure specification is 3000 Tbs/inz.     {Exhibit C).   There appears

       to be no safety hazard from the bursting of the diaphragm.      The unjt °

       appears leak proof and 5 nuts and bolits are used to clamp the unit

       and diaphragms together.


       Conclusion and Recommendatio

       Based on an engineering evaluation, the device does not appear to have

       any effect on emissions and there is no basis upon which to deny

       exemption.   The staff, therefore, reconmends that Palmco Engineering

       Co. be granted an exemption from the prohibitions of Yehicle Code

       Section 27156 for the "Monitor Gasaver" for all 1975 and older model

       year vehicles using gasoline carburetors.
