WHEREAS, Vehicle Code Semtion 27156 and Title 13 California Code of
Regulations (hereafter "CCR") Section 2222(h), authorize the California Air
Resources Board (ARB) anmi—its Executive Officer to exempt new aftermarket
catalytic converters frem the prohibitions of Vehicle Code Section 27156.

WHEREAS, pursuant to themauthority vested in the Executive Officer by Health
and Safety Code Sectiows#39515 and 39516, and in the Chief, Mobile Source
Division by Health and Sifety Code Section 39516 and Executive Order G—45—5,
the Air Resources Board dssued Executive Order D—194 which exempted the
Acousticat, Inc. two—way:catalytic converter series 67120—67124 and three—
way plus oxidation catatytic converter series 67130—67134 from the
prohnibitions of Vehicle Eode Section 27156.

WHEREAS, said exemption eras granted pursuant to and subject to the
"California Evaluation Procedures for New Aftermarket Non—Original Equipment
Catalytic Converters" nequired by Title 13 CCR Section 2222(h) and the
written condition listed:in Executive Order D—194 which required evaluation
by the Air Resources Board to insure compliance with said Executive Order.

WHEREAS, Acousticat, Inc. has violated said procedures required by
requlation and by the condition listed in said Executive Order by its
failure to submit production audit test data or quality control procedures
used in the manufacture of their catalytic converters to the Air Resources
Board in a timely mannervor within the time periods procedurally
established.

IT IS HEREBY RESOLVED that Executive Order D—194 issued July 21, 1989 is
rescinded and that Acousticat, Inc. shall cease and desist the installation,
sale, offer for sale, and advertisement of new aftermarket non—original
equipment catalytic converters in the State of California.
