(Page 1 of 3) State of California AIR RESOURCES BOARD EXECUTIVE ORDER D—254 Relating to Exemptions Under Section 27156 of the Vehicle Code GLOBAL INGENUITY VENTURES PERFORMAX DEVICE WHEREAS, Vehicle Code Section 27156 and Title 13 Caliizsrnia Code of Regulations (hereafter "CCR") Section 2222(e), authoriz:e the California Air Resources Board (ARB) and its Executive Officer to exenpt add—on and modified parts from the prohibitions of Vehicle Code Section 27156. wWHEREAS, Global Ingenuity Ventures has applied to the ARB for exemption from the prohibitions of Vehicle Code Section 27156 for the Performax device. wWHEREAS, pursuant to the authority vested in the Execr:—ive Officer by Health and Safety Code Section 39515 and in the Chief, Mobile Source Division by Health and Safety Code Section 39516 and Executlve Order G—45—5, the ARB finds: 1. The Performax is an add—on device that%is at=—ached in the PCV line in a motor vehicle. i 2. The PCV line is part of the required motor vehicle pollution control systenm. ! 3. The Performax is intended for use wzth]a requxred pollution control system. to . 1 nevmp s uc culuc> 4. The Performax by being installed in the PCV line alters the original design of a motor vehicle pollutxon control system.~ 5. The Performax is a device subject to the prsziibitions of Vehicle Code Section 27156 and an add—on part as de?fined by 13 CCR Section 1900(b)(1). 6. The Performax does not reduce the effective—=ss of any required motor vehicle pollution control device. 7. The ARB, in the exercise of technical judgenent, is aware of no basis on which the Performax will provide either a decrease in emission or an increase in fuel economy. 8. It has not been determined what effect use cfi the Performax may have on any warranty, either expressed or inmslied, by the manufacturer of a motor vehicle on which the device is installed.

The ARB by granting an exemption to Global Ingenuity Ventures for the Performax does not recommend or endorse in any way the Performax for emissions reduction, fuel economy, or any other purpose. IT IS HEREBY RESOLVED that the Performax is exempt from the prohibitions of Vehicle Code Section 27156 for installation on 1992 and earlier model—year vehicles powered with gasoline and diesel internal combustion engines subject to the following conditions: 1. This exemption shall not apply to any device, apparatus, or— mechanism advertised, offered for sale or sold with, or installed on, a motor vehicle prior to or concurrent with transfer to an ultimate purchaser. No changes are permitted to the device as described in the application for exemption. Any changes to the device, applicable model year, or other factors addressed in this order must be evaluated and approved by the ARB prior to marketing in California. Marketing of this device using an identification other than that shown in this Executive Order or marketing of this device for an application otherithan those listed in Executive Order shall be prohibited unless ‘prior approval is obtained from the ARB . Exemption of this ‘product shall not be construed as an exemption to sell, offer for sale, or advertise any ccmponent of the product as an individual devxce. Any oral or writtén references to this Executive Order or its content by the Global Ingenuity Ventures, its principals, agents, employees, distributors, dealers, or other representatives must include the disclaimer that the Executive Order or the exemption it provides is not an endorsement or approval of any fuel economy or emissions reduction claims for the Performax and is only a finding that the device is exempt from the prohibitions of Vehicie Code Section 27156. No claim of any kind, such as "Approved by the ARB" may be made with respect to the action taken herein in any advertising or other oral or written communication.

The order may be revoked only after a ten—day written notice of intention to revoke the order, in which period the holder of the order may request in writing a hearing to contest the proposed revocation. w . Bfiff=n ;y/— PERFORMAX INSZEALLATION INSTRUCTIONS 1. Install the PERFORMAX unit in a appropriate location under the hood of tne venicli= on firewall, fenderwell etc. so as to be convenient for accesa to the PC Vaive and the Inlet Manifold return system on the Engine;The PERFPORMAX unit is installe: between the PC Valve and the Inlet Manifold return so location is importantt. Tre PERFCORMAX unmit should be installed as ciose to upnighgas posgible to operate properliy.( ‘FTne TOP of the unit has the "IN and OUT" fittings ) Secure the unit temporarily with tie wraps or whatever at this tine. ' 2. Remove the existing hose from the PC Valve and the Inlet Manifold returm. Clean PC Valve or replace with new unit, then using the new furnished PCV hose and clamps, attach to PCValve on Engtne and route to the ”IN"-fitting on the PERFPCORMAZ unit, cutting kose to fit without tension, and secure with ‘clamp. (Be sure the PC. Valve is in proper flow direction) ‘ Install the new furnished PCY hose anmnd clamp on the "OUT"vfitting on the PERFORMAX unit then route hose to the lInlet Manifold return and secure with clamp. Install PCV hose with clamp to " Drain " ¥itting on bottom of PERFORNMAX unit and route to a convenient location under vehilcle engine for agcéss to draining when changing oil etc. Install Plug in hose and clamp securelyQ 5. Secure PERFORMAX unit permanently with tie wraps or clamps at this time. Be sure PERFORMAX unit is not close to a heat source such as Exhaust systems or Radiators. 6.Start Engine and check for vacumn leaks etc. Wwhen Throttle is accelerated and released sharply you will observe a FOQG condition in the sight unit of the FERFPORMA unit for a instant. This means that it is working properely. It is suggested at this time to have a qualified Mechanic adjust the Caruretor or F.I. to give optammmPerformance and Emission settingse=End result is more fuel economy, less engine wear, increased performance, and less Air pollution
