State of California AIR RESOURCES BOARD EXECU-I-IVE ORDER D-280-18 Relating to Exerr~ptionsunder Section 271 56 of the Vehicle Code AirTek, Inc. (d.b.a. Catco) "Series 61 2000 OBD ll Compliant Three-way Catalytic Converter" 6 WHEREAS, Vehicle Code Sections 271 56, and'section 2222(h), Title 13, ~ a l i f o r n i aC de of Regulations, authorize the California Air Resources Board and its Executive Officer to exempt new aftermarket catalytic converters from the prohibitions of Vehicle Code Se tion 271 56. WHEREAS, AirTek, Inc. (AirTek) of 4410 W. 37thAvenue, applied to the Air Resources Board for exemption from the Sections 27156 and 38391 to market its new aftermarket Series 612000 three-way converter (TWC) for installation on 1996 through 2000 Ford passenger cars on-board diagnostic II (OBD-II) systems as specified in Appendix D-280-18 herein. The TWC will be used in dual catalytic converter exhaust system (2 only. Series 612000 TWC may also be installed on non-OBD II Ford and older) with similar exhaust configuration as those listed in Appendix D-280-18. WHEREAS, pursuant to the authority vested in the Executive Officer by Health and Code Section 39515 and in the Chief, Mobile Source Operations Division by Health an Safety Code Section 39516 and Executive Order G-02-003, the Air Resources that the above aftermarket catalytic converter complies with the California Vehicle Cod Section 27156 and Section 2222(h), Title 13, California Code of Regulations. performance of said catalytic converter was based on durability bench-aging Research Institute, San Antonio, Texas, using the ARB-modified RAT-A for 75 hours, as specified in the "Optional Evaluation Procedures for original Equipment Catalytic Converters Equipped with On-Board Diagnostic II (OBD II Systems." iP WHEREAS, emissions tests conducted at 'the Ecologic Engine Testing Laboratory (Ec logic), Fullerton, California, with Series 612000 TWC installed on a 1997 3.OL Ford Taurus, e gine test group VFM3.OV8G3EK, certified to the Low Emission Vehicle and passenger car emission standards (LEVIPC), showed that the catalytic converter met the applicable emission standards. OBD II compatibility tests performed on the same test vehicle showed that Series 61 20 0 TWC did not affect the vehicle's ability to perform OBD II system monitoring. IT IS HEREBY RESOLVED that the above catalytic converter is exempt from the in Vehicle Code Section 27156 for installation on the approved vehicle in Appendix 0-280-1 8 subject to the following conditions: 1. No changes are permitted to the catalytic converter as described in the application for exemption. Any changes to the catalytic components, and other factors addressed in this order approved by the Air Resources Board prior to marketing in California. 2. Marketing of the catalytic converter using identifications other than in the exemption application, and in this Executive Order, or catalytic converter for application other ,than the ones. shown Order shall be prohibited ur~lessprior approval is obtained from the Air Resources Board. Exerr~ptionof this product shall not be construed as a exemption to sell, offer for sale, or advertise any converter as individual devices. 3. Any oral or written references to this Executive Order or its content by Inc., its principals, agents, employees, distributors, dealers, or other representatives must include the disclaimer that the Executive Order exemption it provides is not an endorsement or approval of any emission reduction claims for the catalytic converter and is only a finding that the catalytic converter is exempt from the prohibitions of Vehicle Code 271 56. 4. AirTek, Inc.'s installation instructions for the new catalytic converter must conform to requirements in Paragraphs I and X of the "Optional Evaluati Procedures for New Aftermarket Non-original Equipment Catalytic Equipped with On-Board Diagnostic II (OBD II) Systems." 5. Upon installation, the catalytic converter must carry a manufacturer's war for 50,000 miles on the substrates and 50,000 miles or five (5) years on t shell and end pipes. 6. AirTek, Inc. and its vendors may not advertise the new aftermarket catal converter as a "high or easy flow" catalytic converter or use any phrase could make it appear to perform better than an original equipment (OEM) catalytic converter. t 7. AirTek, Inc., its associates, vendors, other businesses, and individuals m y not sell or supply the substrates of the new aftermarket catalytic converter to a third party to be assembled in a different facility and marketed under this Exe tive Order. 8. Any marketing arrangement of the new aftermarket catalytic converter party, which involves the use of packaging identification different from described in this Executive Order, must be approved by Air Resources prior to shipment. 9. AirTek, Inc. must submit the required quality audit and production quantit reports for its aftermarket catalytic converter on a semi-annual basis, cov the periods January Ithrough June 30, and July Ithrough December 31 Violation of any of the above conditions shall be grounds for revocation of this order. order may be revoked only after a ten day written notice of intention to revoke it, period the holder of the order may request in writing a hearing to contest the revocation.
