State of California AIR RESOURCES BOARD EXECUTIVE ORDER D—619 Relating to Exemptions Under Section 27156 of the California Vehicle Code Dynojet Research, Inc. Power Commander III EX Pursuant to the authority vested in the Air Resources Board by Section 27156 of the Vehicle Code; and Pursuant to the authority vested in the undersigned by Section 39515 and Section 39516 of the Health and Safety Code and Executive Order G—02—003; IT IS ORDERED AND RESOLVED: That the installation of the Power Commander III EX, produced and marketed by Dynojet Research, inc. of 2191 Mendenhall Drive, Suite 105, North Las Vegas, Nevada 89081, has been found not to reduce the effectiveness of the applicable vehicle pollution control systems and, therefore, is exempt from the prohibitions of Section 27156 of the Vehicle Code for the following 2007 model year and older on road motorcycle applications as listed in Exhibit A. The Power Commander I!I EX is an etectronic control module (ECM) that works with the stock motorcycle‘s ECM, and is installed in series to the stock wiring harness of the ECM. The Power Commander III EX allows the user of the motorcycle to increase or decrease the amount of fuel going into the combustion chamber. Ignition timing modifications are also allowed for Harley Davidson motorcycles. Modifications are made using a computer; there are no user adjustments on the device. This Executive Order is valid provided the installation instructions for the Power Commander i1 EX will not recommend tuning the motoreycle to specifications different from those of the Dynojet Research, Inc. Changes made to the design or operating conditions of the Power Commander II! EX, as exempt by the Air Resources Board, which adversely affect the performance of the vehicle‘s pollution control system shall invalidate this Executive Order. Marketing of the Power Commander HI EX using any identification other than that shown in this Executive Order or marketing of the Power Commander I!II EX for an application other than those listed in this Executive Order shall be prohibited unless prior approval is obtained from the Air Resources Board. This Executive Order does not constitute any opinion as to the effect the use of the Power Commander III EX may have on any warranty either expressed or implied by the vehicle manufacturer.

2. This Executive Order is granted based on submitted emission test data generated on four motorcycles. Test results showed that emission levels, with the Power Commander II EX installed, met the applicable emission standards when tested using the Cold—Start CVS— 75 Federal Test Procedure (FTP).
