                        EXECUTIVE ORDER D—14—5—A
              Relating to Exemptions under Section 27156
                          of the Vehicle Code


                          ENERGY PRODUCTS, INC.
                             "V. C. METER"


Pursuant to the authority vested in the Air Resources Board by Section
27156 of the Vehicle Code; and

Pursuant to the authority vested in the undersigned by Section 39023 of
the Health and Safety Code;

IT IS ORDERED AND RESOLYED:   That the installation of the "V. C. Meter"
manufactured by Energy Products, Inc. of 4340 Redwood Highway, San
Rafael, California 94903 has been found to not reduce the effectiveness
of required motor vehicle pollution control devices and, therefore, is
exempt from the prohibitions of Section 27156 of the Vehicle Code for
1972 through 1975 model—year vehicles with engines greater than 140 CID.

The device consists of a relief valve with a filter and can be identified
by "V. C. Meter" stamped at the bottom of the housing. The valve is
inserted between the PCV valve and the intake manifold and permits a
small amount of additional air to enter the PCV line.

This Executive Order is valid provided that installation instructions
for this device will not recommend tuning the vehicle to specifications
different than those listed by the vehicle manufacturer.

Changes made to the design or operating conditions of the device, as
exempted by the Air Resources Board, that adversely affect the performance
of the vehicle‘s pollution control system shall invalidate this Executive
Order.

Marketing of this device using an identification other than that shown
in this Executive Order or marketing of this device for an application
other than those listed in this Executive Order shall be prohibited unless
prior approval is obtained from the Air Resources Board.

This Executive Order does not constitute any opinion as to the effect
that the use of this device may have on any warranty either expressed or
implied by the vehicle manufacturer.


"V. C. METER"                                        EXECUTIVE ORDER D—14—5—A


THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION,
APPROVAL, OR ANY QTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF
ANY CLAIMS OF THE APPLICANT CONCERNING ANTI—POLLUTION BENEFITS OR ANY
ALLEGED BENEFITS OF THE "V. C. METER" DEVICE.

No claim of any kind, such as "Approved by Air Resources Board" may be made
with respect to the action taken herein in any advertising or other oral
or written communicatton.

Section 17500 of the Business and Professions Code makes unilawful, untrue
or misleading advertising, and Section 17534 makes violation punishable as
a misdemeanor.

Sections 39130 and 39184 of the Health and Safety Code provide as follows:

     "39130. No person shall install, sell, offer for sale, or advertise,
     or, except in an application to the board for certification of a
     device, represent, any device as a motor vehicle poliution control
     device unless that device has been certified by the board. No
     person shall sell, offer for sale, advertise, or represent any motor
     vehicle pollution control device as a certified device which, in
     fact, is not a certified device. Any vioiation of this section is
     a misdemeanor."

     "39184. (a) No person shall install, sell, offer for sale, or adver—
     tise, or, except in an application to the board for accreditation of a
     device, represent, any device as a motor vehicle poliution control
     device for use on any used motor vehicle unless that device has been
     accredited by the board. No person shall sell, offer for sale, adver—
     tise, or represent any motor vehicle poliution control device as an
     accredited device which, in fact, is not an accredited device.    Any
     violation of this subdivision is a misdemeanor."

Any apparent violation of the conditions of this Executive Order will be
submitted to the Attorney General of California for such action as he deems
advisable.

Executive Order D—14—5, dated March 19, 1975, is superseded and of no further
force and effect.

                               Staff Report


                   Evaluation of Energy Prodcts, Inc.
                    "V. C. Meter" Air Bleed Valve for
                   Compliance with the Requirements of
           Section 27156 of the California Motor Vehicle Code


      Introduction

      Energy Products, Inc. of 4340 Redwood Highway, San Rafael, California

      94903 had requested permission to market a device called "V. C. Meter"

      which was manufactured by Albano Enterprises, Inc. of Santa Ana,

      California and is identical in construction and performance to

      the "Air Jet" device also manufactured by Albano Enterprises.    This

      permission was granted by E*ecutive Order D—14—5,   The "Air Jet"

      device, as submitted by Albano Enterprises, was evaluated by the Air

      Resources Board Staff and found to not adversely effect the emission

      control system.   Executive Order D—14—3 was issued to Albano Enterprises

      granting the exemption for the "Air Jet" device for 1972—1974 mode!—

      year vehicles with engines greater than 140 cubic inch displacement.


II.   Device Description

      For a description of the construction and operation of the "V. C. Meter",

      see the report on the Staff‘s evaluation of the "Air Jet" device dated

      March 27, 1974.

111. Conclusions and Recommendation

    The Staff has evaluated the "Air Jet" device and found that it has
    no significant effects on exhaust emissions.   It is the opinion of

    the Staff that the "V. C. Meter" device being identical in construction

    and performance would also produce the same effect.


    Energy Products, Inc., in a letter dated April 7, 1975, stated that

     it now manufactures the V. C. Meter itself and requests that the name

    of Albano Enterprises be deleted from Executive Order D—14—5.


    The Staff recommends that Executive Order D—14—6—A, showing the new

    manufacturer, be adopted and Executive Order D—14—5 be rescinded.

We ENERGY PRODUCTS, INC., have authorized "Hollywood Access—
ories" 19914 South Via Barron, Compton, California 90020 ,
to exclusively distribute the V.C. METER Nationally.

I understand that they have applied for such séttion from
your board and need the approval from the parent company
Energy Products, Inc., to the Air Resources Board. They
have indeed received our approval for just such distribution
from our office.

Since Mr. Kaffen has already spoken to about this company,
I pray there will be no difficulty from the Board.

It has been noted, that the Exempiion for the 1975 auto—
mobles indicated that the Meter was being manufactured by
the same Albano Interprises and distributed by Energy Pro—
ducts, Inc..This I believe was an oversight on your behalf
for the reasons, that Mr. Kaffen mentioned. We are the man—
ufacture       of   the   Meter   and plan   to   continue   same.

The last trip as you might recall, we brought in some samples
of our manufactured V.C. METER made by us here in the Bay
Area. This sampling was for the purpose of your evaluation
and I believe your exemption indicated same.

we would be most pleased, if the name of Albano Interprises
was left out of our Exemption and replaced with the parent
