                  Relating to Exemptions under Section 27156
                             of the Vehicle Code

                    GULF & WESTERN MANUFACTURING COMPANY
                     SYSTEMS GROUP—AUTOMOTIYVE QPERATIONS
                   BREAKERLESS ELECTRONIC IGNITION SYSTEM


Pursuant to the authority vested in the Air Resources Board by Section
27156 of the Vehicle Code; and

Pursuant to the authority vested in the undersigned by Section 39515 of
the Health and Safety Code and Executive Order G—30A;

IT IS ORDERED AND RESOLVED: That the installation of the General Motors
Truck and Coach Electronic Ignition Retrofit kit part number 2234808 °
manufactured by Gulf and Western Manufacturing Company, Systems Group—
Automotive Operations, 17500 Northland Park Court, Southfield, Michigan
48075 has been found to not reduce the effectiveness of required motor vehicle
pollution control devices and, therefore, is exempt from the prohibitions
of Section 27156 of the Vehicle Code for 1974 and older model year vehicles
equipped with 12 volt battery, standard ignition coil, negative ground and
eight cylinder Delco distributor._ This exemption does not include those
venteies originally equipped with breakerless or electronic ignition systems.

The device consisté of an amplifier magnetic sensor, interrupter wheel and
wiring harness.

This Executive Order is valid provided that installation instructions
for this device will not recommend tuning the vehicle to specifications
different from those lTisted by the vehicle manufacturer.

Changes made to the design or operating conditions of the device, as
exempted by the Air Resources Board, that adversely affect the per—
formance of a vehicle‘s poliution control system shall invalidate
this Executive Order.

Marketing of this device using an identification other than that shown
in this Executive Order or marketing of this device for an application
other than those listed in this Executive Order shall be prohibited unless
prior approval is obtained from the Air Resources Board.

This Executive Order does not constitute any opinion as to the effect
Fhat.the use of this device may have on any warranty either expressed or
implied by the vehicle manufacturer.                              ‘

No claim of any kind, such as "Approved by Air Resources Board" may be made
with respect to the action taken herein in any advertising or other oral
or written communication.

Section 17500 of the Business and Professions Code makes untrue or mis—
leading advertising unlawful, and Section 17534 makes v1olat1on punishable
as a misdemeanor.

Section 43644 of the Health and Safety Code provides as follows:

       "43644.   (a) No person shall install, sell, offer for sale, or adver—
       tise, or, except in an application to the state board for certification
       of a device, represent, any device as a motor vehicle pollution control
       device for use on any used motor vehicle unless that device has been
       certified by the state board. No person shall sell, offer for sale,
       advertise, or represent any motor vehicle pollution control device as
       a certified device which, in fact, is not a certified device. Any
       violation of this subdivision is a misdemeanor."                 .

Any apparent violation of the conditions of this Executive Order will be
submitted to the Attorney General of California for such action as he deems
advisable.

Dear Mr. Drachand:

Mr. T.M. Fisher, Director—Automotive Emissions Control, GM Tech Center
recently communicated with you regarding exemption to MV code section
27156 for General Motors Truck & Coach Electronic Ignition retrofit kit
#2234808. Mr. Luczynski called me on November 1, 1976 to inform me that
all such requests must originate with the manufacturer of the system.

Gulf + Western, therefore, requests exemption to the MV code section
27156 for General Motors Truck & Coach Electronic Ignition retrofit kit
#2234808.    Gulf + Western manufactures this kit for GMC Truck & Coach, and
the kit is functionally identical with the Zenith kit for GM—8 application
(single pack #130—10).     There is absolutely no change in the GMC unit as
compared to the Zenith unit other than the nameplate and packaging. The
CMC Electronic Ignition kit will be merchandised by a "single pack". This
Zenith kit was exempted by the Califormia Air Resources Board by Executive
Order #D—58, August 12, 1975.  I believe a sample of the GMC kit has already
been received by Mr. Luczynski for your evaluation.

 Dear Mr. Drachand:

 This is in response to your October 1, 1976 letter concerning a GMC
 Electronic Ignition Conversion Kit, manufactured by Gulf and Western
 Manufacturing Company. Please consider this letter as a formal appli—
 cation for an exemption of this kit from the prohibitions of California
 Motor Vehicle Code Section 27156.

 In support of this request, we are aftaching a letter from Gulf and Western
 Manufacturing Company that is relevent to the application,. This letter
 states that the GMC kit is functionally identical with the Zenith kit that
 you have already exempted by Executive Order D—58. A copy of the
 executive order, your staff report, and the application submitted by Gulf
 and Western for exemption of the Zenith kit is attached.

 Since the Zenith kit is functionally identical to the GMC kit, we see no
 need to supply additional data to support our application for exemption.
 However, we are sending you one of the kits for any further evaluation
 that you wish to perform.

 Should additional information be required, please let us know.

This letter is to certify that the General Motors Truck and Coach
Electronic IEgnition retrofit kit #2234808 is functionally identical with
the Zenith kit.for GM—V8 application (single pack #130—10).   This Zenith
kit for CM—V8 applications was approved by the California Air Resources
Board on August 12, 1975 with Executive Order #D—58.

There will be absolutely no change in the GMC unit as compared to the
Zenith unit other than the nameplate (label) and packaging constructlon
The GMC Electronic Ignition kit will be merchandized by a"51ng1e pack‘
kit identical to the "Zenith" single pack kit.
