The Fuelpak is installed in series to the stock wiring harness of the ECM and allows the user of the motorcycle to input a code designed to increase or decrease the amount of fuel going into the combustion chamber. Ignition timing is not modified. The code is selected based on other legal modifications made to the motorcycle (e.g. air cleaner or exhaust system). Installation does not require the modification or removal of any sensor or emission control device. The Fuelpak is not designed to allow a user to download or modify the programming.

                      Relating to Exemptions Under Section 271 56
                                 of the California Vehicle Code

                     V & H Performance, Inc. (d ba Vance & Hines)
                                     Fuelpak

Pursuant to the authority vested in the Air Resources Board by Section 271 56 of the
Vehicle Code; and

Pursuant to the authority vested in the undersigned by Section 39515 and
Section 39516 of the Health and Safety Code and Executive Order G-02-003;

IT IS ORDERED AND RESOLVED: That the installation of the Fuelpak, produced anc
marketed by V & H Performance, Inc. (dba Vance & Hines) of 13861 Rosecrans
Avenue, Santa Fe Springs, California 90670, has been found not to reduce the
effectiveness of the applicable vehicle pollution control systems and, therefore, is
exempt from the prohibitions of Section 271 56 of the Vehicle Code for the following
2007 and 2008 model year Harley Davidson motorcycle applications.

The Fuelpak is an electronic control module (ECM) that works with the stock
motorcycle's ECM and is designed to increase fuel into the combustion chamber durir
high load conditions.

This Executive Order is valid provided the installation instructions for the Fuelpak will
not recommend tuning the motorcycle to specifications different from those of the V &
Performance, Inc.

Changes made to the design or operating conditions of the Fuelpak, as exempt by thc
Air Resources Board, which adversely affect the performance of the vehicle's pollutio~
control system shall invalidate this Executive Order.

Marketing of the Fuelpak using any identification other than that shown in this Execut~
Order or marketing of the Fuelpak for an application other than those listed in this
Executive Order shall be prohibited unless prior approval is obtained from the Air
Resources Board.


This Executive Order does not constitute any opinion as to the effect the use of the F i
may have on any warranty either expressed or implied by the vehicle manufacturer.

This Executive Order is granted based on submitted emission test data generated on         0
motorcycles. Test results showed that emission levels, with the Fuelpak installed and
programmed, met the applicable emission standards when tested using the Cold-Star
CVS-75 Federal Test Procedure (FTP). Results from emission testing conducted at
Ecologic Testing Laboratory, located in Fullerton, California, are shown below in grarr    3er
kilometer with deterioration factors applied.

Similar effect on motorcycle emissions is expected with the installation of the
Fuelpak on motorcycles listed in this Executive Order.

The Air Resources Board reserves the right in the future to review this Executive Ordt     and
the exemption provided herein to assure that the exempted add-on or modified part
continues to meet the standards and procedures of Title 13, California Code of
Regulations, Section 2222, et seq.

ANTI-POLLUTION BENEFITS OR ANY ALLEGED BENEFITS OF V & H
PERFORMANCE, INC. 'S FLIELPAK.

No claim of any kind, such as "Approved by the Air Resources Board", may be made           th
respect to the action taken herein in any advertising or other oral or written communic    on.

Violation of any of the above conditions shall be grounds for revocation of this order.    le
order may be revoked only after a ten-day written notice of intention to revoke the ord    , in
which period the holder of the order may request in writing a hearing to contest the
proposed revocation. If a hearing is requested, it shall be held within ten days of recc   t of
the request and the order may not be revoked until a deterr~iinationis made after the
hearing that grounds for revocation exist.
