o f t h e Vehicle Code; and
Pursuant t o t h e a u t h o r i t y vested i n t h e undersigned b y Sections 39515 and
39516 o f t h e Health and Safety Code and Executive Order 6-45-5;
I T I S ORDERED AND RESOLVED: That t h e i n s t a l l a t i o n o f t h e add-on 0.82 AIR

Performance Turbocharger Assembly components manufactured b y Turbonet ics ,
I n c . o f 650 F l i n n Ave., U n i t 6, Moorpark, CA 93021, has been found n o t t o
reduce t h e e f f e c t i v e n e s s of t h e a p p l i c a b l e v e h i c l e p o l l u t i o n c o n t r o l system
and, t h e r e f o r e , i s exempt from t h e p r o h i b i t i o n s o f Section 27156 o f t h e
Vehicle Code f o r t h e 1986-1987 model-year Buick Regal Grand NationalIT-Type
3.8L V6 turbocharged, i n t e r c o o l e d , f u e l i n j e c t e d engine and t h e P o n t i a c
Turbo Trans Am equipped w i t h t h e same engine. M o d i f i c a t i o n s t o t h e OEM
emission-related p a r t s due t o i n s t a l l a t i o n o f t h e Stage 1/11 Upgrade o r t h e
Stage 1/11 Performance Turbocharger Assembly i n c l u d e a hose adapter f o r t h e
s t o c k a i r mass sensor hose due t o t h e r e - c o n f i g u r a t i o n o f t h e compressor
i n l e t connection from t h e s t o c k a i r mass sensor and r e l o c a t i o n o f t h e
passenger s i d e p o s i t i v e crankcase v e n t i l a t i o n (PCV) breather connection due
t o t h e re-conf igured compressor i n l e t connect ion.
This Executive Order i s v a l i d provided t h a t i n s t a l l a t i o n i n s t r u c t i o n s f o r
t h e turbocharger components w i l l n o t recommend t u n i n g t h e v e h i c l e t o - -
specTfications d i f f e r e n t from those submitted by Turbonetics, I n c .
Changes made t o t h e design o r o p e r a t i n g c o n d i t i o n s o f t h e t u r b o c h a r g e r
components, as exempt b y t h e A i r Resources Board, which a d v e r s e l y a f f e c t the
performance o f a v e h i c l e ' s p o l l u t i o n c o n t r o l system s h a l l i n v a l i d a t e t h i s
Executive Order.

Marketing o f these turbocharger components using any i d e n t i f i c a t i o n o t h e r
than t h a t shown i n t h i s E x e c u t i v e Order o r marketing o f these turbocharger
components f o r an a p p l i c a t i o n o t h e r than those l i s t e d i n t h i s E x e c u t i v e
Order s h a l l be p r o h i b i t e d unless p r i o r approval i s obtained f r o m t h e A i r                          -
Resources Board.
This Executive Order does n o t c o n s t i t u t e any o p i n i o n as t o t h e e f f e c t t h e
use o f t h e turbocharger components may have on any warranty e i t h e r expressed
o r i m p l i e d by t h e v e h i c l e manufacturer.

            This Executive Order is granted based on test results verifying that the
            turbocharger is not functional during the CVS-75 Federa 1 Test Procedure
            (FTP) driving cycle. However, the ARB finds that reasonable grounds exist
            to be1 ieve that use of the turbocharger components may adversely affect
            emissions of motor vehicles when operating under conditions outside the
            parameters of the previously prescribed test procedures. Accordingly, the
            ARB reserves the right to conduct additional emission tests, in the future,
            as such tests are developed, that will more adequately measure emissions
            from all cycle phases. If such test results demonstrate that the
            turbocharger components adversely affects emissions during off-cycle
            conditions (defined as those conditions which are beyond the parameters of
            the Cold-Start CVS-75 Federal Test Procedure), this Executive Order shall be
            effectively rescinded as of the date the test results are validated.
            Further, If such test results or other evidence provides the ARB with reason
            to suspect that the turbocharger components will affect the durability of
            the emission control system, Turbonetics, Inc. shall be required t o submit
            durability data to show that the durability of the vehicle emission control
            system is not, in fact, affected and/or that the add-on or modified part
            demonstrates adequate durability.
            In addition t o the foregoing, the ARB reserves the right in the future t o
            review this Executive Order and the exemption provided herein to assure that
            the exempted add-on or modified part continues to meet the standards and
            procedures o f Title 13, California Code o f Regulations section 2222 et seq.
                     THIS EXECUTIVE ORDER DOES NOT CONSTITUTE A CERTIFICATION, ACCREDITATION,
                     APPROVAL, OR ANY OTHER TYPE OF ENDORSEMENT BY THE AIR RESOURCES BOARD OF
                     CLAIMS OF THE APPLICANT CONCERNING ANTI-POLLUTION BENEFITS OR ANY'ALLEGED
                     BENEFITS OF TURBONETICS, INC.'S TURBOCHARGER COMPONENTS.

                     made with respect to the action taken herein in any advertising or other
                     oral or written communication.
            Section 17500 of the Business and Professions Code makes untrue or
            misleading advertising unlawful, and Section 17534 makes violation
            punishable as a misdemeanor.
            Section 43644 of the Health and Safety Code provides as follows:
                  "43644, (a) No person shall install, sell, offer for sale, or
                  advertise, or, except in an application to the state board for
                  certification of a device, represent, any device as a motor vehicle
                  pollution control device for use on any used motor vehicle unless that
                  device has been certified by the state board. No person shall sell,
                  offer for sale, advertise, or represent any motor vehicle pollution
                  control device as a certified device which, if fact, is not a certified
                  device. Any violation of this subdivision is a misdemeanor."
